Abstract
This study aims to analyze the operation of exile during the Korean Empire and explain its significance. Due to the introduction of a new punishment, imprisonment, during the Gabo Reform period, the scope of exile was reduced to state crimes. In addition, under the influence of Japanese criminal law, the place of exile was limited to islands, and this was clearly stated in the 『Hyeongbeob Daejeon』. During the Korean Empire, an island called Chul do(鐵島) in Hwanghae Province began to be used as a place of exile. The island had been inhabited since the Goryeo Dynasty and was under the control of the state. During the reign of King Gojong, after the General Sherman incident in 1866, a Chul do was set up on the naval base and detached a military officer to military utilize the island. Based on the analysis of the official document 『Sabeoppumbo』 from the Gabo and Daehan Empire periods, it was determined that there were cases of exile to railroads from 1897 to 1908, and that approximately 25% of all exiles during the same period were exiled to railroads. This shows that Chul do emerged as a representative place of exile in Joseon during the Daehan Empire. When compared to the regulations on island exile in Joseon, the use of railroads as places of exile did not conflict greatly with the laws of the traditional era. However, considering the basic intention of imposing heavy sentences on criminals through exile to distant islands after the Gabo Reform, railroads close to the mainland were not places of exile that were suitable for that purpose. Furthermore, there are no confirmed cases of criminals exiled to the islands being released upon completion of their sentences. This was a phenomenon that occurred as political power abused the use of commutation and pardons. Meanwhile, as the railroad emerged as a new place of exile, most of the expenses necessary for exile administration were passed on to the people of the island. Considering these facts together, it can be seen that the criminal administration of the Korean Empire was operated more abnormally due to the influence of political power than before the Gabo Reform.
