Abstract
Restorative justice is not aimed at punishing criminals but emphasises conflict resolution between the parties. In this respect, it is linked to the diversion, which means discharge from the formal judicial procedure. In particular, the UK government has been instructing the police to actively utilise restorative interventions in deciding whether to administer a caution or a conditional caution. These measures are based on the recognition that restorative justice procedures would be effective not only in recovering victim’s harm but also in preventing offender’s re-offending. Where the agreement obtained through a restorative meeting is imposed as a condition, it will be possible to secure the compliance of the conditional caution. Nevertheless, in practice, caution and conditional caution do not fully function restoratively. Victims were not fully notified of the information of restorative justice and some PCC areas only offer victims restorative justice once the offender has been convicted. Practical problems in UK provide many suggestions concerning the implementation of restorative justice in Korea. In order for the restorative justice to be successful, it will be necessary to provide victims enough information about restorative justice, to balance the interests of the victim and the offender, and to establish a standardised restorative intervention program.
