집회·시위 관리정책에서 ʻ한국형 대화경찰ʼ 제도의 의미

2016년의 촛불집회 이후 한국 경찰의 집회·시위 관리정책은 ‘자율과 책임에 기반한 평화적 집회·시위 보장 및 대응’으로 진화하였지만, 경찰개혁위원회에서 권고한 평화적·비폭력 집회·시위를 최대한 보장하기 위한 근본적인 변화를 달성하기에 한계가 있었다. 이를 보완하기 위하여 경찰은 집회·시위 현장의 소통창구이자 갈등의 완충지대의 역할을 담당하는 ‘한국형 대화경찰’ 제도를 도입하였다. ‘한국형 대화경찰’ 제도는 2016년 촛불집회에서 시민은 집회·시위의 자유를 누리고 경찰은 이를 보호하는 이상적인 집회·시위가 이루어질 수 있다는 경험, 집회·시위 참가자를 이성적인 판단·소통이 가능한 집단지성을 소유하고 있어 대화를 통해 불법·폭력 상황을 스스로 자정할 수 있다는 신뢰를 바탕에 둔 이론적 기반의 전환, 시민 의식의 성장과 함께 변화하는 다양한 갈등 양상에 대해 인권과 안전의 관점에서 유연하게 대응할 필요성 등이 어우러져 만들어낸 새로운 형태의 집회·시위 관리정책이다. 집회·시위에서 대화와 조정의 역할을 담당하기 위하여 스웨덴의 대화경찰을 본받아 도입한 제도이지만, 그 발전적 철학과 장점은 수용하되 한국의 상황에 맞추어 개념과 역할을 재정립한 정보경찰 중심의 집회·시위 관리정책이라는 점에서 의미가 있다.
Abstract
After the candlelight vigils in 2016, the Korean police’s policy of Managing Assembly and Demonstration evolved to ‘guarantee and respond to peaceful rallies and demonstrations based on self-reliance and responsibility’. However, there was a limit to achieving fundamental changes to ensure peaceful and nonviolent assembly and demonstration as recommended by the police reform committee. To compensate for this, the police introduced the “Korean Dialogue Police” system, which was responsible for providing communication channels and serving as a buffer zone for conflicts at the assembly and demonstration sites. The “Korean Dialogue Police” system is a new form of assembly and demonstration management policy created by combining the following three elements : (1) The experience that citizens enjoy freedom of assembly and demonstration in 2016 and the police can conduct ideal assembly and demonstration to protect them; (2) the conversion of theoretical bases based on the trust that they can self-correct illegal and violent situations through dialogue; and (3) the need to flexibly respond to various conflicts that change with the growth of civic consciousness from the perspective of human rights and safety. The system was adopted after Sweden’s “Dialogue Police” to play the role of dialogue and coordination in assembly and demonstration. However, while embracing its advanced philosophy and merits, the concepts and roles were re-established to suit the situation in Korea. It is meaningful in that it is the Policy of Managing Assembly and Demonstration centered on intelligence police.
