아동 및 장애인 대상 조사역량 강화를 위한 기초 연구- 경찰 조사관의 수사면담 교육 및 제도 만족도를 중심으로 -

초록

성범죄 및 학대 사건에서 피해자인 아동 및 장애인의 진술이 사건의 주요 증거로 채택되는 사례가 증가하면서 과학적인 수사면담의 시행에 이목이 집중되고 있다. 미국 등 해외에서는 학술연구 및 현장 자료들을 토대로 수사면담을 수행하는 조사관에 대한 체계적인 교육 및 지속적인 훈련의 필요성, 그리고 관련 제도정립 등을 강조하고 있다. 국내에서도 관련 제도의 활성화와 함께 현재 해바라기센터 소속 경찰 조사관 등을 대상으로 수사면담 기법에 관한 전문교육이 정기적으로 이루어지고 있다. 그러나 경찰 조사관들 대상으로 한 수사면담 교육 및 제도의 만족도나 그 효과성에 대한 직접적인 검증은 제대로 이루어지지 않고 있다. 이에 본 연구는 해바라기센터에서 아동 및 장애인 수사면담 업무를 담당하고 있는 현직 경찰 조사관들을 대상으로 아동․장애인 수사면담과 관련된 각종 교육 및 제도들에 대한 의견과 더불어 앞으로 어떤 개선이 필요한지에 대하여 설문조사와 심층면담을 통해 확인해보고자 하였다. 연구결과, 경찰 조사관들은 현재 운영되는 교육 및 제도에 대해 대체로 만족하고 있는 것으로 확인되었다. 그러나 그들이 수사면담을 진행했던 사건의 재판결과에 대한 피드백의 필요성, 장애인 수사면담 기법의 교육 강화, 기질적으로 까다로운 아동 대상의 면담진행에 대한 구체적이고도 실현가능한 대안 제시 필요 등의 의견이 제시되었다. 본 연구의 결과는 향후 아동 및 장애인 수사면담 시 양질의 진술 획득을 위한 교육 및 제도의 구성과 개선에 기초자료로 활용될 수 있을 것으로 기대된다.

Abstract

With rising number of cases in which statements of children and individuals with disabilities are accepted as empirical evidence for brutal crimes, such as sexual violence and physical abuse, much attention is focused on the appropriate process of investigative interviews and the reliability of the statements. The importance and rationale of systematic education and continuous training for appropriate investigative interviews is widely known in foreign countries based on extensive research and field data. The Korean National Police Agency (KNPA) is also exploring measures to obtain reliable statements from children and individuals with disabilities. Some of these measures include providing regular education on investigations and NICHD investigative interviewing technique for investigators working at Sunflower centers nationwide, having statement assistants and public defenders of the interviewee present during investigative interviews, and receiving feedbacks from colleagues and having statement experts analyze the statements. In this context, this study aimed to lay a foundation for improving the quality of education by surveying current police officers in charge of conducting investigative interviews with children and the disabled regarding their opinions on various education programs and systems as well as on whether these education programs and systems are helpful for investigative interviews and what improvements should be made.
