영국의 비디오 라인업 범인식별진술 제도에 관한 비교법적 고찰

대법원 판례 또는 수사기관의 실무지침은 기본적인 범인식별진술 방법론으로서 라이브 라인업과 사 진제시법을 규정하고 있다. 다만 현장 실무에서는 주로 사진제시법 후 직접대면의 방법이 많이 활용 되고 있는데, 이러한 방법론은 식별오류의 가능성이 상대적으로 높으며 피해자 친화적인 방법론도 아 니다. 이와 대조적으로, 영국에서는 2003년부터 비디오 라인업이 범인식별진술의 법적 ․ 실무적 원칙 으로 자리 잡고 있다. 특히, 우리의 수사기관이 주로 활용하는 사진제시법이나 직접대면은 “용의자의 신분 확인이 가능하고 즉시 출석이 가능한 상황”에서는 (영국에서는) 법적으로 금지되어 있는 바, 이 러한 규정과 실무적 통제방안은 우리에게 상당한 정책 시사점을 보여주고 있다. 이러한 배경 하에 본 연구는 우리나라 범인식별진술의 대안을 제시하고 나아가 비디오 라인업 운용 방안을 좀 더 구체적으로 도출하기 위한 목적으로, 영국의 비디오 라인업 범인식별진술 제도에 관한 비교법적 고찰을 실시하였다. 이를 위하여 먼저 본 연구는 “PACE법”, “실무규칙 D”, “부속지침 A” 등 에 규정된 비디오 라인업과 관련된 법체계, 요건 및 절차 등을 심도 있게 살펴보았다. 또한 영국경찰이 실무적으로 사용하고 있는 비디오 라인업 기술프로그램인 VIPER와 PROMAT의 운영방식 및 특징 등도 살펴보고 서로 비교 ․ 분석해보았다. 이러한 영국의 비디오 라인업제도가 (법적인 운용방식 및 통제방안 포함하여) 도입된다면, 범인식별진술의 경제성 및 신속성이 확보될 수 있으며 아울러 피해자 친화적인 식별진술 제도가 될 수 있을 것이다. 부가적으로 진술오류의 위험성이 낮아지므로, 범인식별 진술 방법론의 증명력은 더욱 더 높아질 것이라고 판단된다.
Abstract
Criminal investigations sometimes need a visual identification procedure to enable victims or eyewitnesses to establish the identity of offenders. To this end, the Korean law enforcement agencies usually take advantage of “Confrontation after Photo-spread (Showing photographs)”, although the verdicts of the Supreme Court as well as visual identification guidance published by the Prosecution Service and the National Police Agency in Korea suggest two basic main visual identification methodologies: Live lineup (Live Identification Parade) and Photo-spread. In contrast to such Korean practices, photo-spread and confrontation are not allowed by law, particularly PACE, Code D, in the UK because the two identification methods can increase the possibility of identification errors in the situations where the suspect is known and available. Instead, video identification parade has legal top priority in that situation from 2003. In this context, the research tries to investigate PACE, Code D, and Annex A, respectively in order to look into the very specific regulations, procedures, conditions, and prohibitions of the UK’s video identification parade legislation. Furthermore, this study investigates and compares the history, operation and characteristics of the VIPER and PROMAT programs practically utilized by the British local police forces. The author strongly believes that the research findings can contribute to the practical application of the UK’s video identification parade in Korea.
