재외국민보호체계 강화 방안에 대한 연구: 경찰주재관의 역할 중심으로

국제협력 및 공조에는 인터폴을 통한 협력과 국제형사사법공조라는 두 가지 프레임워크가 존재하나, 최근에 경찰주재관을 통한 협력이라는 새로운 방식이 적용되고 있다. 외교부에서는 각 전문분야별로 재외공관 외교활동을 보좌하기 위해서 국가공무원을 선발하여 파견하는 주재관 제도를 운용하고 있고, 그중 하나가 경찰주재관이다. 경찰주재관은 재외국민보호, 범죄자 검거를 위한 수사공조, 국제범죄 관련 자료수집, 그리고 주재국 법집행기관과의 협력체제 구축 등 임무를 수행하고 있다. 본 연구에서는 경찰주재관의 역할을 명확히 하고 역할 간 모순 내지 충돌로 인한 문제점을 도출하고 이에 대한 해결방안을 제시하고자 하였다. 질적연구에서 사용하는 프레임워크 분석방법(Framework analysis)을 적용하여 경찰주재관들을 대상으로 수집된 자료를 분석하고, 다음과 같은 결과를 도출하였다. 첫째, 선행연구에서 제시한 역할과 실제 주재관들이 수행하는 역할의 동일함이 확인되었다. 둘째, 역할 모순과 문제점의 발견으로, 재외국민보호활동과 범죄자 검거를 위한 수사공조활동이 충돌하는 경우가 발생하였다. 이 경우 전자인 활동은 영사조력법이라는 근거법이 있지만, 후자인 활동은 근거법이 명확하지 않았다. 또한, 한 국가나 지역 내에서 근무하는 다른 파견 지위를 가진 경찰관 사이에 역할갈등의 문제도 발생할 수 있다. 마지막으로, 역할 모순 내지 갈등을 해결하기 위해 두 가지 방안을 제안하였다. 첫 번째는 파견 형태를 투 트랙으로 분리하여 경찰주재관은 영사조력활동에 집중하고, 경찰협력관은 경찰청에서 요청하는 수사공조활동 등을 수행하는 것으로 분리하는 방안이다. 두 번째는 재외국민보호활동은 외교부 소속 임기제 (부)영사가 담당하고, 경찰주재관은 형사사법 관련 법집행 공조활동을 담당하는 방안이다.
Abstract
There are two frameworks for international cooperation: cooperation through Interpol and mutual legal assistance for criminal justice, and cooperation through police attachés is quite new. The Ministry of Foreign Affairs operates an attaché system and one of them is the police attaché. Police attachés carry out duties such as protecting citizens abroad, cooperating in investigations to arrest criminals, collecting data related to international crimes, and establishing a cooperative system with law enforcement agencies in the host country. This study clarified the role of the police attachés, identified problems caused by conflict between roles, and suggested solutions. The framework analysis was applied to analyze the collected data, and the following results were derived. First, it was confirmed that the roles presented in previous studies were the same as those actually performed by the attachés. Second, role contradictions and problems were discovered. There were cases in which activities to protect Korean nationals abroad and cooperation in investigations to arrest criminals collided. In this case, the former activity has a basis law called the Consular Assistance Act, but the latter activity was not clear. In addition, a problem of role conflict may arise between police officers with different status serving in the same country or region. Finally, two methods were proposed to resolve role contradiction. One is to separate the form of dispatch into two tracks, with police attachés concentrating on consular assistance activities, and police cooperation officers carrying out investigation and cooperation activities. The other is to make police attachés in charge of law enforcement cooperation activities related to criminal justice.
