엔터테인먼트 산업에서의 분쟁의 해결은 우리나라에서는 거의 대부분 전통적인 소송을 통해서 처리한다는 인식이 지배적이다. 이 논문은 중재라는 대안적인 해결 방법과 소송의 경제적 그리고 시간적 비용을 비교해서 이런 인식을 바꿔 보려는 시도로 소송과 중재의 절차를 설명하고 이 두 분쟁 해결 방법의 장단점을 논한 뒤, 비용을 추산하여 비교해 보았다. 중재는 비용과 시간의 절감은 물론 프라이버시의 보장으로 대중적 인기에 특히 민감한 엔터테인먼트 산업의 스타들에게 유리한 분쟁 해결 수단이 될 수 있다는 점을 지적했다.
Abstract
In Korea, the popular conception has been that disputes in the entertainment industry should be resolved through the conventional method of litigation. This paper aims to change such a preconception by comparing the costs involved in litigation and arbitration. After the administrative procedures of litigation and arbitration are explained and the advantages and disadvantages of these two methods are compared, the costs of litigation and arbitration are estimated and contrasted. Since arbitration can protect the privacy of parties involved in the entertainment industry and speed up the process in addition to lower costs of the legal process, arbitration is the appropriate method of resolving disputes in the entertainment industry.
