환태평양경제동반자협정과 의약품 관련 지식재산 및 제도 : 협정문 내용 변화를 중심으로

2015년 10월, 세계 최대 무역협정인 환태평양경제동반자협정(TPP)이 오랜 진통 끝에 타결되었다. 본 연구는 협상 과정에 주목하여 TPP 협정문의 구체적 내용과 구조적 모호함을 공개된 협정문과 비교하여 분석하고 협상막바지 단계의 이슈연계에 주목하여 최종 협정문의 변화를 설명하였다. 최종 협정문은 미국 무역대표부가 공개한 자료를, 공개된 협정문은 위키리크스 등이 공개한 자료를 사용하였다. 미국은 협상 막바지단계에서 타결을 위하여 생물의약품 자료보호와 다른 조항들을 연계하여 논의하였다. 논의 결과 생물의약품 자료보호가 최종 협정문에 추가되었으며, 이에 대한 반작용으로 다른 조항들의 내용이 중·저소득 국가의 의약품 접근을 고려하는 방향으로 변화하였다. 하지만 이는 공개된 협정문과 비교하여 판단한 것이며, 최종 협정문은 여전히 중·저소득 국가의 의약품 접근을 제한할 우려가 있는 조항을 포함하고 있다. 또한 최종 협종문은 생물의약품 자료보호, 허가특허연계, 특허권 보호기간 연장 조항에서 여전히 구조적 모호함을 가지고 있다. 이들 조항에 대하여 회원국은 구조적 모호함을 적극적으로 해석하고 의약품 접근에 미치는 부정적 영향을 최소화하여 국내법에 반영할 필요가 있다.
Abstract
The purpose of this study is to analyze the final Trans-Pacific Partnership(TPP) agreements on the pharmaceutical system. Also, this study noted the transition in agreements by analyzing leaked and final agreements available at the Wikileaks and USTR. Compared with the leaked agreements, final agreements considered access to medicines in low- and middle-income countries more meaningfully in some areas and devised more specific clause on patent linkage, patent term adjustment, and data exclusivity still with constructive ambiguities on them. This transition would be explained by issue linkage at the final negotiation stage. United States argued data protection for biologics which had not been discussed until 2013 and linked it with other provisions that were deemed to cause potential problems. However, compared with TRIPs, final agreements has TRIPs-plus provisions and regulations on pharmaceutical reimbursement and pricing that might limit access to medicines in low- and middle-income countries. To deal with the final agreements, member countries should interpret constructive ambiguities in agreements actively and amend domestic legislations accordingly that favor access to medicnes.
