헌법재판소의 정치적 성격: 주요 판례와 재판관 구성을 중심으로

이 연구는 한국 헌법재판소의 정치적 성격이 정치과정 내에서 어떻게 나타나고 있는지 분석한다. 정치의 사법화는 한국만이 아닌 세계적 추세로서 헌법재판소의 정책결정자로서의 역할 등에서 나타나는 정치적 성격에 관한 관심이 증가하고 있다. 그리고 그 과정에서 헌법재판관들의 결정행태에 관한 논의가 폭넓게 진행 중인데, 판사들이 전략적 또는 상호의존적 결정을 한다는 전략적 선택이론을 배경으로 한 연구가 현재의 지배적인 경향이다. 이 연구에서는 세 개의 헌법재판소 판례의 분석을 통하여 헌법재판소가 한국 정치의 사법화 과정에서 중요한 역할을 하고 있는 것을 보았는데, 이 사건들의 경우 재판관들의 임명배경에 따라서 그들의 결정내용에서 차이가 나타났다. 그 차이의 확인을 위하여 실시한 159개 판례의 분석으로 재판관들의 임명배경에 따른 결정 태도의 차이를 일부 볼 수 있었다. 이와 같이 헌법재판관의 구성에 있어 실질적인 임명권을 행사한 자가 누구인가 하는 문제는 헌법재판소의 정치적 성격을 연구하는데 있어 매우 중요한 의미를 가지고 있다고 본다.
Abstract
This paper analyzes the political characteristic of Korean Constitutional Court within the political process. Judicialization of politics is worldwide trend and Constitutional courts are regarded as one of the important policy makers in state’s governance. Discussions on behavior of constitutional court justices and the role of constitutional court as a state policy maker are widespread. Particularly, Strategic Choice theory that claims justices make strategic or mutually dependent decision, are currently dominant theories. In this paper, critical precedents significantly influenced judicialization of Korean politics are analyzed. The result shows that Constitutional justice’s discrepancies are related with their appointment background. It is partly affirmed through empirical analysis of differences of Justice’s judicial decision on appointment background. Therefore, the issue of who actually hold appointment power of the Constitutional Justices is so important.
