헌법교육은 법학교육의 차원과 법교육의 차원으로 나누어 볼 수 있다. 그 중 법교육의 차 원에서 바라보는 헌법교육은 생활법 중심 법교육에서 놓치기 쉬운 가치교육의 측면을 가지 고 있다. 그 가치교육의 차원은 외국에서 계수한 한국의 법체계가 갖는 맥락에 대한 비판적 이해, 법체계를 움직이는 이면의 가치원리의 이해 그리고 혼동된 우리 법의식의 반성적 고 찰 등을 포괄한다. 특히 그 내용적 측면에서 필자는 첫째 헌법의 역사적 함의, 둘째 입헌주 의에 대한 이해, 셋째 공동체적 삶의 관점에서 헌법을 성찰하는 것 등이 포함되어야 한다고 생각한다. 나아가 이러한 큰 방향에서 헌법교육의 목표를 설정하고 구체적인 교육방법을 모 색하는 것이 바람직할 것이다.
Abstract
Constitution education is divided into the dimension of legal education and the dimension of law-related education. In the perspective of law-related education, constitution education has the dimension of values education, which people are apt to miss. The dimension of values education comprehends the critical understanding of the context of korean legal system that had received from the West, the understanding of essential principles of legal system and the reflective consideration of our confused legal consciousness. And I propose that the contents of constitution education include the historical implication of constitution, the understanding of constitutionalism and the reflection of constitution in the communal life. Furthermore, it is desirable to establish the goal of constitution education and find the applicable education method according to these values and contents.
