본 연구의 목적은 법교육 차원에서 인권교육과의 관계를 확인하고, 한미 법교육 교재 분석을 통해 인권내용 개선방안을 모색하는 것이다. 지금까지 법교육 차원에서 인권내용을 법교육 교재에 법교육 차원에서 시민권을 다룬 연구는 많았지만, 인권교육과의 관계를 고려하여 인권내용을 실질적으로 다룬 연구는 많지 않았다. 이런 법교육이 준법교육에 불과하다는 비판적 시각도 있다. 이런 점을 감안하여 본 연구는 법교육과 인권교육의 관계를 살펴보고, 분석기준을 마련하여 한ㆍ미 법교육 교재를 분석하였다. 분석 결과를 토대로 본 연구에서 인권내용 개선을 위해 제안하고자 하는 것은 다음과 같다. 첫째, 인권을 실질적으로 다룰 단원을 마련하기 위해 생활영역 중심이 아닌 생활 주제를 고려한 단원 구성방안을 도입할 필요가 있다. 둘째, 인권을 효과적으로 학습하기 위한 체계적인 본문구성이 필요하다. 셋째, 보편적 인권의 발달과정과 전망, 법적 과제 등을 제시할 필요가 있다. 넷째, 시사성 있는 인권관련 사례를 제시할 필요가 있다. 다섯째, 법과 인권을 실질적으로 이해하고 법 제도 개선을 위해 필요한 소양을 기르기 위한 다양한 학습활동요소 개발이 필요하다.
Abstract
The purpose of this study is in terms of law-related education to affirm relationship between law-related education and human rights education, seek the improvement of human rights contents through the analysis of Korean and American law-related education textbook. So far in terms of law-related education there have been researches on civil rights, but have been little researches substantially dealing with contents of human rights. There is critical perspective that law-related education is only law-abidance teaching. Considering these points this study examines relationship between law-related education and human rights education, analyze Korean and American law-related education textbook with standards of analysis. Based on the results of analysis for improving contents of human rights this study is proposed that as follows. First, for substantially dealing with the contents of human rights, it is necessary to adopt the way of section configuration considering not living area but living-related topics. Second, for effectively studying human rights it is necessary to make up systematic text. Third, it is necessary to offer the development of universal human rights and the process, legal challenges etc. Fourth, it is necessary to present topical cases related to human rights. Fifth, for substantially understanding law and human rights, bringing up refinement to improve legal system, it is necessary to develop various learning activities elements.
