미국 변호사 시험의 최근 동향 및 시사점 - 출제 및 평가를 중심으로 -

최근 들어 우리나라에서 변호사시험 제도 개선을 위한 활발한 논의가 이루어지고 있다. 법학전문대학원이 출범한 지 10여년이 지나면서, 자연스럽게 현행 변호사시험의 제도에 대한 재평가가 요구되고 있기 때문이다. 그런데 논의의 방향은 대부분 변호사시험의 합격률 또는 합격자 수 산정에 초점이 맞추어져 있다. 법학전문대학원 관계자 또는 학생들은 합격률 상향을 주장하는 반면, 법조계 종사자들은 대부분 합격자 수가 현행대로 유지되어야 한다고 반박하고 있다. 미국에서도 우리나라와 유사하게 최근 몇 년간 변호사 시험의 합격률이 계속 하락하였지만, 논의의 초점은 우리나라와 다소 상이하다. 물론 합격률에 대한 논쟁도 있지만, 그 외에도 변호사 시험 자체가 충분한 법률적 지식을 갖춘 응시생을 타당하고 신뢰성 있게 선별하고 있는지, 변호사시험 합격에 영향을 미치는 요인들은 무엇인지, 수준 미달 로스쿨 또는 학생들에 대한 조치는 무엇이 필요한 지 등 다양한 측면에서 논의가 이루어지고 있다. 우리나라도 이러한 점들을 참고하여 보다 다양한 시각에서 현행 변호사시험 제도의 개선을 위한 노력이 나타날 필요가 있다. 특히 전문자격시험으로써의 변호사 시험의 근본적인 목적이 보다 비중 있게 고려될 필요가 있다. 변호사 시험은 예비 변호사의 법률적 지식 또는 능력을 충분히 검증함으로서, 시민들이 불완전한 법률서비스로부터 보호하는 것을 주된 목적으로 한다. 변호사시험 합격자 결정과 관련된 논의에서도 이러한 변호사시험의 목적이 충분히 반영되어야 한다. 나아가 경험적으로 축적된 사회과학 연구 성과를 활용하여 변호사시험의 출제·평가 과정을 보다 정교하게 운영함이 바람직하다.
Abstract
Recently, there have been increasing discussions on improving the bar examination system in South Korea since 10 years have been passed since the establishment of the Law School system, and the passing rate of bar examination is consistently decreasing. Most of the discussions merely focus on the passing rate or the number of successful applicants for the exam. In the United States, the passing rate of bar examinations has also continued to decline in recent years. But the focus of discussions is somewhat different from those of South Korea. Of course, there is also a debate about the passing rate. However, others also exist: whether the bar examination is selecting the candidates with sufficient legal knowledge in a reasonable and reliable way; what factors affect the result of applicants; and what is needed for the failed applicants and law schools. In South Korea, it is necessary to refer to the discussions in the U.S. and make efforts to improve the current bar examination system from various perspectives. Particularly, the fundamental purpose of the bar examination needs to be considered aiming at ensuring that citizens should be protected from incomplete legal services. Furthermore, it is desirable to more elaborately manage the bar examination system by utilizing psychometric research output.
