프린키파투스 시기 재정감독관과 청부업자의 관계－로스토프체프의 유형론을 중심으로－

속주 아시아 관세법에 나오는 관세징수 청부업자의 명칭이 ‘데모시오네스(δημοσιώνης)’였는데, 기원후 62년에 해당하는 행에서는 징수자인 ‘텔로네스(τελώνης)’로 변한 것은 푸블리카니가 배제되고 콘둑토레스로 대체된 것을 시사한다. 이런 변화와 아울러서 재정감독관(procurator)인 에피트로포스(ἐπιτρόπος)가 등장하여 청부업자와 같이 활동하는 것을 보여준다. 이 재정감독관은 처음에는 속주 정무관과 징수청부 업자 간의 결탁을 막고 납세자를 보호하는 소극적인 역할을 보였으나, 기원후 62년에는 청부업자와 같이 납세신고를 받을 정도로 업무를 간섭한다. 이들은 황실지의 관리감독으로 성장하여 황제의 측근이 된다. 이 직책은 기사 신분자들만 아니라 해방노예도 가질 수 있었으니, 신분상의 차별은 없었던 것으로 보인다. 일반적으로 콘둑토레스가 국가 소유를 청부하는 푸블리카누스나 만켑스, 레뎀프토르를 몰아내고 청부업자의 대세가 되었다. 각종 공공단체의 청부를 비롯하여 황실지의 청부를 맡게 되면서, 청부의 개념이 매매에서 임대차로 바뀌게 되었다. 이는 사적 영역이 국가의 공적 영역에도 끼어들고 대체하게 되면서 푸블리카니의 존재 의미가 없어지게 되었다. 재정감독관과 청부업자는 구분이 있지만, 나중에는 한 사람이 장악하게 된다. 이것이 제정 전기 징세청부와 관련하여 일어난 중요한 변화상이다.
Abstract
The title of tax collector changes from ‘demosiones’ to ‘telones’ at the line dating to 62 A.D. in the Customs Law of Asia. This change means that the publicans were replaced by the private contractor named ‘conductor.’ And a financial overseer titled ‘epitropos’ operates with the contractor. The former is a procurator, who was first appointed by Emperor Augustus for the protection of the tax payers. The overseer’s role was at first only in shattering the relations of tax contractors and provincial magistrates. Afterwards they grew up both in the control of the tax collectors and in the management of the Emperors’ private lands, which had been enlarged by various confiscations and donations. So the title was open both to the equestrians and to the freedmen besides the slaves without any discrimination. At the same time the title of conductor prevailed in state contracts replacing publicans, mancipes or redemptores. And the technical term of contract changed from buying-selling to the lease-rent as they participated more in the income contract of Emperor’s farms. This means that the private contracts prevailed in public matters. Finally the roles of overseer and contractor tended to converge into one person. That is the way for the nationalization of the private tax-gathering enterprises.
