공동체 토지신탁의 주택 공급에 대한 함의: 재매도 가격 산정방식을 중심으로

초록

도시지역에서 토지와 주택을 저렴하게 배분하려고 많은 노력과 비용을 들였음에도 아직도 해결할 이슈들이 산적해 있으며, 최근 주택정책에서 주요 이슈는 부담가능 주택의 공급과 그 지속성이라고 해도 과언이 아닐 것이다. 우리나라도 2009년 토지임대부 분양주택 등 주택을 저렴하게 공급하려는 많은 시도가 있었으나, 재매도에 대한 명확한 규정을 두지 않고 있다. 이에 따라 본 연구는 부담가능 주택의 지속성을 확보하기 위해 미국에서 도입되어 최근 확산하는 공동체 토지신탁을 소개하고, 부담가능 주택의 지속성 유지에 핵심적인 사항인 재매도 방식에 대해 검토하고, 그에 따른 함의를 도출하고자 하였다. 분석결과 순수하게 건물가격만 적용하는 감정평가 방식은 부담가능성을 유지하는데 큰 효과가 있으나, 도출되는 가격이 과도하게 낮게 도출되었다. 따라서 향후 토지임대부 분양주택 및 지분적립형 분양주택 등을 위해서는 거주자의 지분을 합리적으로 인정할 수 있는 제도를 마련해야 한다.

Abstract

Despite substantial costs and efforts invested in making land and housing more affordable in urban areas, numerous challenges persist. It is not an exaggeration to state that the primary issues in recent housing policies revolve around the supply and sustainability of affordable housing. In 2009, Korea made several attempts to provide low-cost housing, such as ‘land-lease housing for sale,’ but clear regulations on resale are lacking. Therefore, this study aims to introduce community land trusts, which have recently gained popularity in the United States as a means to ensure the sustainability of affordable housing. The study also reviews the resale method, considered a key aspect for the sustainability of affordable housing, and derives implications. The results of the analysis reveal that the appraisal method, which considers improvements only, significantly contributes to maintaining affordability. However, given the various methods used to distribute appropriate residents’ shares, it is necessary to establish a system that can reasonably allocate residents’ shares for ‘land-lease housing for sale’ and ‘shared house ownership’.
