지방토지수용위원회 재결의 실태와 개선방안: 경상북도 지방토지수용위원회의 재결을 중심으로

Abstract

With the recent emergence of the welfare state and the expanding concept of public interest, the role of the land tribunal as an adjudication agency has become increasingly important. This is due not only to the rise in public work projects but also to the significant increase in public interest projects conducted by private entities. This study addresses the lack of research on the actual status of land tribunal adjudications by analyzing cases adjudicated by the Gyeongsangbuk-do Local Land Tribunal in 2021 and exploring potential improvements. The main findings and suggested improvement measures are as follows: First, to enhance the administrative procedures before applying for adjudication, it is proposed to strengthen and standardize the requirements and procedures for project approval and adjudication applications. Second, to improve the operation of the land tribunal, the study suggests establishing the local land tribunal as a permanent independent body, innovating the public announcement and review system, ensuring thorough deliberation during tribunal proceedings, and clearly stipulating the criteria for rejection and dismissal of adjudication applications.
