Abstract

This paper reviews the impact of international standards on Korean juvenile justice system through referring to related material. It covers the issues around juvenile delinquent in the Korean Juvenile Act, child in the Child Welfare Act and youth in the other Acts on juvenile protection. The outline of this paper is as follows: Chapter 1. Introduction Chapter 2. International Standards on Juvenile Justice Chapter 3. Relationship of Korean Juvenile Justice and International Standards Chapter 4. Conclusion The international standards on juvenile justice seems to be a mixture of welfare model(child welfare), justice model(children’s rights and due process) and participant model(subjectivity of child, children’s rights of participation and statement). It could be a good model for Korean juvenile justice. South Korea as a member of the United Nations and the Convention on the Rights of the Child needs to follow the guideline of CRC and other international standards on juvenile justice.
