지명분쟁의 예방과 해결에 관한 연구

본 연구는 지명분쟁의 사례를 조사ㆍ분석하여 분쟁의 원인 및 해결과정에서의 한계점을 도출하고, 도출된 한계점을 토대로 지명분쟁의 예방 및 합리적 해결방안을 모색하였다. 연구의 목적을 효율적으로 달성하기 위해 지명분쟁을 연구대상으로 한정하고, 그에 따른 연구범위는 다음과 같이 설정하였다. 우선, 시간적 범위는 지명분쟁이 사회적 이슈로 제기되기 시작한 1990년부터 현재까지로 하였고, 공간적 범위는 우리나라에 국한하였으며, 내용적 범위는 지명분쟁의 예방 및 해결방안을 제시하는 것으로 설정하였다. 연구의 접근방법은 행정적 접근방법과 법률적 접근방법에 기초하였고, 조사방법은 문헌조사법과 사례조사법, 인터넷조사법을 병행 하였으며, 분석방법은 기술적(記述的) 분석법을 사용하였다. 연구결과를 토대로, 본 연구는 지명결정시 사전적 예방조치로서는 현행 측량법에 지명부여 시 주민의 의견수렴 조항을 신설할 것과, 의견수렴 이후 지명의 지정 및 변경에 관한 심의에 앞서 공공기관의 갈등 예방과 해결에 관한 규정에 제시된 갈등영향평가기법을 활용하여 지명분쟁영향평가서를 작성토록 하고 지명위원회의 심의회의에 반영하는 방안을 제언하였다. 다음으로, 지명이 결정된 이후 발생된 지명분쟁에 대해서는, 가칭 「지명분쟁조정위원회」를 설치하고 조정과정을 거쳐 합의를 이끌어 내는 방안을 제언하였다.
Abstract
The objective of this study was to find a methods for prevention and solution of place name disputes by researching and analysing the precedents. For this goal, we have focused on the years from 1990 when the place name disputes raised as social issue up to now, and restricted the spatial scope within Korea. Then we accomplished the task. In order to carry out this study, we employed a legal and administrative approach method. Moreover we used the method of a documentary reference and a case method and an internet research to acquire the data needed. In addition, we adopted the descriptive analysis method to analyze the data. In this study, we proposed the alternative plans; the Surveying Law needs some provisions that inhabitants' suggestion can be incorporated in the plan. And also, in case the place name disputes occur after deciding the name, government has to carefully examine the establishment of tentatively named “Mediation Committee of Place Name Dispute”.
