Abstract
Traditionally, the U.S. criminal jury trial requires a unanimous jury verdict. However, Oregon and Louisiana have allowed for non-unanimous jury verdicts. There have been many problems since the U.S. Supreme Court ruled in 1972 that the non-unanimous verdict laws in Oregon and Louisiana were constitutional in the Apodaca v. Oregon and Johnson v. Louisiana decisions. However, in April 2020, the U.S. Supreme Court reversed itself, ruling in the Ramos v. Louisiana that the right to a jury trial under the 6th Amendment requires a unanimous guilty verdict. Thus, the previous precedent, the Apodaca ruling, has been abolished, and guilty verdicts in criminal jury trials in federal and all states courts of the US must now be unanimous. A jury verdict in the Korean Citizen's Participation Trial process is not binding, does not necessarily require unanimity, and may be rendered by majority vote. Thus, the Korean Citizen's Participation Trial differs from the American jury trial. However, the recent U.S. Supreme Court case on the unanimous jury verdict has many implications for the debate on reforms to the Citizen's Participation Trial process to make jury verdicts binding and guilty verdicts unanimous. Considering the democratic nature of a criminal jury trial, a legally binding effect should be afforded to the jury verdict of the Citizen's Participation Trial. In addition, the jury verdict of the Citizen's Participation Trial should be unanimous in view of the beyond a reasonable doubt standard. In this respect, this paper reviews the US Supreme Court's Ramos v. Louisiana decision, which called for unanimous guilty verdicts, in a comparative law perspective.
