Abstract
A public prosecution may be withdrawn before a judgment in the first instance is rendered. When a ruling dismissing public prosecution as a result of its being withdrawn becomes final, a new public prosecution can be instituted for the same offense only if it is based upon newly discovered material evidence. The public prosecutor may, with permission of the competent court, add, delete or change charges or applicable provisions of Acts stated in the indictment. In this case, the identity of the charges shall not be disturbed. In cases where the court deems it reasonable in view of trial process, they shall request for the addition or change of charges or applicable provisions of Acts. Changes in indictment and withdrawal of public prosecution are expressions of principle of discretionary change of indictment. This article analyzes the case on changes in indictment and the case on withdrawal of public prosecution from a different perspective from the existing one. Just as principle of discretionary indictment is not principle of arbitrary indictment, there is a limit to principle of discretionary change of indictment. However, the limitations should be set differently in consideration of the functional and practical differences between the two systems. From this point of view, first in the case of resolving the violation principle of indictment without surplusage, re-prosecution is allowed after withdrawal of public prosecution. And then a change in the indictment that only adds to the punishment at the appeal trial should be disallowed if certain requirements are met.
