세속국가의 헌정질서와 교회의 공론 작업-루터의 율법설교에 한 해석에 근거하여

세속국가의 헌정질서에서 교회는 공론의 장에 참여하여 어떤 방식으로 자신의 의견을 공적으로 표명해야 하는가? 본 논문은 이 질문에 대한 답변을 찾기 위해 우선 교회와 국가의 헤게모니 동맹을 중심으로 한 콘스탄틴적 기독교 국가 체제 가 해체되고 세속국가의 헌정질서인 정교분리 원칙이 확립되어 간 과정을 분석하 고, 세계관적 중립의 원칙을 지키는 세속국가의 헌정질서에서 공론의 장이 작동 하는 방식을 분석했다. 공론의 장에서 이글은 이성의 공적 사용에 근거하여 비판 적 공개성이 창설되고 구현되는 과정에 초점을 맞추면서 교회가 국가와 세상의 형성에 관련된 공적인 의견을 표명해야 할 근거를 제시하기 위하여 루터가 두 정부론의 틀에서 교회의 파수꾼 역할을 수행하기 위하여 율법설교를 통하여 펼친 공적 담론을 분석했다. 그리고 교회의 파수꾼 역할을 기본적인 모티프로 받아들 인 EKD가 공론의 장에 참여하여 여론을 형성하는 역할을 수행하는 방식을 검토 했다. 특히 EKD의 공적 의견 표명에서 상황분석과 신학적-윤리적 판단의 상호 매개 방식을 규명하고, 그 한계를 지적하면서, 세계관적 주장의 층위와 공적 의견 의 담론적 구성의 층위를 구별할 필요가 있다는 점을 논증했다. 끝으로 본 논문 은 교회의 세계관적 주장을 정교한 언어로 가다듬는 경우라 해도 그 주장이 공론 의 장에서 쉽게 받아들여지지 않는다는 것을 인내하고, 세상에 대한 교회의 의견 은 공개적 논증을 통해 그 정당성을 확보하는 담론능력을 갖추어야 한다고 제안 했다.
Abstract
How should the church participate in the public sphere and express her opinions publicly in the constitutional order of secular state? This article attempts to answer to this complicated question as following. First, this study analyzes the process in which the secular state has replaced the Christian state based on the hegemonic alliance of church and state. Second, this research investigates how the public sphere operates in the constitutional order of the secular state under the principle of neutrality to world-views. Third, in order to present plausible reasons why the Church should express her opinions publicly regarding political and social problems, this article analyzes Martin Luther’s concept on the role of the church as watchman for the state and the world, and also his model of summon on laws which he used as public discourse in the framework of two government doctrine. Lastly, the public opinion work of the Protestant Church in Germany (Evangelische Kirche in Deutschland = EKD) is analyzed to grasp that situation analyses and theological-ethical arguments in EKD's public opinion work are not connected in a sufficiently persuasive art. In regard to church’s public opinion work in the constitutional order of the secular state, this research suggests that the church should be equipped with discourse ability to secure legitimacy of her public opinions through open and critical argumentation.
