中国保险法中信赖利益保护的制度体系

信赖利益保护理念已经在合同法中建立并发展得越来越成熟.宥于保险制度之特殊机制,保险合同上的信赖利益又有其自身特性,因此信赖利益保护问题在保险合同中也有所不同.而另一方面,我们尚需注意,保险合同法中的许多制度都体现了信赖利益保护的理念,但是其呈现的状态却显得非常零散.因而,本文就将对信赖利益以及其在保险合同中的特殊性进行探讨,并对保险合同法中的相关制度加以整合.
Abstract
The conception of protecting the reliance interest has been established and becoming more and more mature in the field of the contract law.Owing to the special mechanism of the insurance system,the reliance interest in the insurance law is particular.Accordingly,the protection for the reliance interest is different.However,on the other hand,we still need to notice that the conception of protecting the reliance interest is reflected in many insurance law systems,but its pattern is rather fragmentary.Therefore,this paper will mainly discuss the reliance interest and its particularity in the field of the insurance law,then related systems is further integrated.
