WTO 보조금협정상 경제특구 내 정부지원의 지역 특정성에 관한 고찰 - 한 - 중 FTA 산업단지를 중심으로 -

초록

경제특구(special economic zones)는 한 국가가 특수한 목적을 가지고 그 국가 내 조성한 일정한 범위의 특별한 구역이다. 경제특구는 국가의 경제발전을 위한 수단으로 활용되어 왔다. 따라서 경제특구 내의 기업들은 정부로부터 다양하고 파격적인 재정적 지원을 받는 것이 일반적이다. 그럼에도 불구하고 이러한 경제특구는 그 자체로 WTO 보조금협정상 분쟁의 대상이 되지 않았다. 하지만 최근 미국이 중국의 경제특구 내 정부의 서비스 지원에 대해 보조금협정 위반이라고 주장한 사례가 있다. 한국은 중국과 FTA 체결 후 한-중 FTA 산업단지 조성을 계획하고 있다. 경제특구의 일종인 한-중 FTA 산업단지에는 지금까지 없었던 토지임대특혜라는 지원혜택이 주어진다. 따라서 경제특구 내 직접적인 재정지원이 아닌 경제특구라는 지역 내 제공되는 정부 서비스에 대한 보조금협정관련 쟁점을 분석하여 한-중 산업단지 내 정부지원에 대한 시사점을 도출할 필요가 있다. 따라서 본 논문에서는 우선, 경제특구 내 다양한 정부지원과 이들 지원의 WTO 보조금협정상 분쟁 가능성에 대해 논의 해 본다. 다음으로 경제특구 내 정부지원이 WTO 보조금협정상 지역 특정성과 어떠한 쟁점 있는지에 대해 분석하도록 한다. 더불어 본 장에서는 중-미 보조금 분쟁 사례의 분석을 통해 한-중 산업단지에 대한 토지임대 특례조치에 대한 시사점을 도출하도록 한다.

Abstract

Special economic zones(SEZ) is a special area which a country creates on a purpose with special aims. On the process of economic development, it has played important role as a foundation of economic development. Thus, the companies within the SEZ are granted special and exceptional financial subsidy from a government. Nevertheless, the SEZ has not been subjected to the dispute under WTO SCM agreement. However, the case has happened that the United State has requested for consultation to WTO that Chinese government provides service support within the SEZs, arguing the measure constitutes the breach of WTO SCM agreement. After concluded Korea-China FTA, Korea plans to make Korea-China FTA Industrial Complex according to the FTA. The FTA Industrial Complex will be offered a subsidy, special admission for land, which has never been offered before. Under the background, it is necessary to analyze the subsidy issue which a government provides services only within the SEZ. It has implication for the government supports provided within Korea-China FTA industrial complex. Thus, the paper will discuss a variety of government subsidies provided in SEZ, and the possibility to occur any conflicts in accordance with WTO SCM agreement at first. And then it will analyze the issues related with regional specificity of government subsidy under WTO SCM agreement. Furthermore, it will draw any implication for the special admission for land by Korean government as examining the China-US subsidy dispute.
