中国的外国人相关法律发展历程与外国人基本权利 主体资格研究

中国《宪法》 第二章规定了“公民的基本权利和义务”， 公民是基本权利 的主体. 然而全球化时代的到来， 使得国家之间的交往日益密切， 外国人 这一群体开始出现在我们的视野当中.《宪法》 没有明确规定外国人享有 哪些权利， 仅仅规定了保障外国人的“合法权利和利益”. 本文对建国初 期以来的外国人相关法制的变化中得知中国的外国人相关法律制度结 构， 随着社会的发展从严格管控到逐渐松动的政策转变. 有关外国人基本 权利主体地位的理论学说， 结合宪法规定阐述了外国人基本权利主体地 位的认定.
Abstract
Chapter II of China’s Constitution stipulates “the fundamental rights and obligations of citizens”, and citizens are the subjects of fundamental rights. However, with the advent of the era of globalization, the interaction between countries has become closer and closer, and the group of foreigners has begun to appear in our view. The Constitution does not specify the rights enjoyed by foreigners, but merely guarantees the “legitimate rights and interests” of foreigners. In this paper, we learn from the changes of foreign-related legal system since the founding of the People’s Republic of China that the structure of foreign-related legal system. The theoretical theory about the subject status of foreigners’ basic rights is expounded in combination with the constitutional provisions.
