Abstract
This paper critically examines the judicial practice in which the defendant’s exercise of the right to remain silent is treated as a disadvantageous factor in sentencing. The right to remain silent is a fundamental right guaranteed by the Constitution and concretized as a defense right of suspects and defendants under the Criminal Procedure Act. However, the Supreme Court has taken the position of dividing the scope of protection of this right, and further, in cases where it deems the right to have been abused, it considers the defendant’s attitude as part of the “circumstances after the offense” under Article 51(4) of the Criminal Act, thereby treating it as a factor for increasing the sentence. Such an approach cannot be regarded as a full guarantee of the right to remain silent under the Constitution and the Criminal Procedure Act, and in effect compels defendants to make statements against their own interests. Accordingly, this study seeks to analyze situations in which the right to remain silent is infringed and to propose measures for ensuring its substantive protection within criminal proceedings.
