2022년 발생한 이른바 ‘신당역 살인 사건’에서는 동료 여직원에 대해 스토킹 범죄를 일으킨 가해자가 회사 내부망을 통해 피해 근로자의 개인정보를 확인하고 역 업무공간에 접근함으로써 범행이 가능했다. 유족은 사용자를 상대로 개인정보보호의무 및 안전보호의무 위반 등을 주장하며 손해배상을 청구했는데 법원은 사용자의 안전보호의무 위반을 인정하지 않았다. 법원은 사용자의 안전보호의무 위반 책임을 인정하기 위해서 업무관련성과 예견가능성이 충족되어야 한다는 기준을 강조한다. 대상 판결에서 법원은 지하철 역사라는 사업장의 위험성, 2인1조 근무 필요성, 평소 폭력 및 성범죄 위험 등을 충분히 고려하지 않았다는 아쉬움이 있다. 직장 내 젠더폭력, 괴롭힘 등에 관한 사용자의 보호의무의 중요성이 높아지고 있는 상황에서 이 사건에서 문제된 안전보호의무에 관해서는 사업장의 구조적 위험과 평소 사고 발생 가능성, 젠더폭력의 특성 등을 종합적으로 평가해야 한다.
Abstract
In the so-called “Sindang Station murder case” that occurred in 2022, the perpetrator—who had committed stalking offenses against a female coworker—was able to carry out the crime by accessing the victim’s personal information through the employer’s internal network and entering the station’s work area. The bereaved family brought a claim for damages against the employer, alleging breaches of the duty to protect personal information and the duty to ensure workplace safety; however, the judgment at issue did not find a breach of the employer’s duty of care and protection. The court emphasized that, in order to establish employer liability for breach of the duty to ensure safety, both a sufficient connection to the employment and foreseeability must be satisfied. The judgment is open to criticism in that the court did not sufficiently take into account the risks inherent in a subway station as a workplace, the necessity of two-person staffing, and the ongoing risks of violence and sexual crimes. Given the growing recognition of the significance of employers’ protective obligations concerning workplace gender-based violence and harassment, the duty of care and protection implicated in this case ought to be evaluated in a holistic manner, taking into account the structural risks inherent in the workplace, the foreseeable risk of accidents, and the particular nature of gender-based violence.
