한ㆍEU FTA하의 원산지인증수출자에 관한 검증사례와 실무적용상 유의점에 관한 연구

원산지인증수출자의 자율증명제도하에서 수입자는 송품장 또는 기타 상업서류에 원산지인증수출자가 작성한 원산지신고서의 제출을 통해 세관에 수입물품의 원산지를 증명하여야 한다. 수출국의 관세당국은 수출물품에 대한 원산지증명 능력을 가지고 있는 수출자를 원산지인증수출자로 인증할 수 있다. 원산지인증수출자는 협정에서 정하는 범위에서 해당 물품에 대하여 자율적으로 원산지를 증명할 수 있으며, 원산지증명에 관하여 간소한 절차를 적용받을 수 있다. 본 연구는 한ㆍEU FTA하의 원산지인증수출자와 관련된 검증사례를 살펴보았으며, 이를 통해 동 FTA를 활용하여 특혜관세 혜택을 향유하고자 하는 무역기업에 다음과 같은 시사점을 제시하고자 한다. 먼저 한ㆍEU FTA에서 규정하고 있는 특혜관세의 적용기준에 대한 확인과 원산지신고서의 발행기준을 확인하여야 한다. 그리고 원산지신고서상의 인증수출자번호에 대한 유효성 확인, 협정관세 사후적용 신청기한과 원산지 검증기한을 확인하여야 한다. 마지막으로 수출국의 간접검증 결과에 대한 해석기준을 확인하여야 한다.
Abstract
Under the origin approved exporter self-certification system, the importer shall verify the customs house the origin of imported goods by submitting an origin declaration made by an origin approved exporter on an invoice or other commercial document. The customs authorities of the exporting country may certify the exporter who has the ability to prove the origin of exported goods as the origin approved exporter. An origin approved exporter may autonomously prove the origin of the relevant goods to the scope stipulated in the relevant agreement and may be eligible for the application of the simplified procedures for proving origins. Among the FTAs in Korea, the KoreaㆍEU FTA, KoreaㆍEFTA FTA and KoreaㆍTurkey FTA are implementing the approved exporter system. In order to achieve the purpose of this study, this paper uses the literature research and case analysis on the origin approved exporter under the KoreaㆍEU FTA. Through this study, this paper is to provide several implications for companies seeking the benefits of the KoreaㆍEU FTA preferential tariffs. The Korean companies to do the following: confirm the application criterion of preferential tariffs stipulated in the KoreaㆍEU FTA, confirm the issuance criterion of the origin declaration, confirm the validity of customs authorization number under the origin declaration, confirm the deadline for ex post facto of conventional tariffs and origin verification, and confirm the interpretation criterion on the indirect verification results of the customs authorities of the exporting country.
