UCP600이 적용되는 신용장에서 수익자는 불가항력으로 인한 은행의 영업중단으로 유효기일 이내에 서류를 제시하지 못하면 신용장대금을 받을 수 없다. 이것은 ISP98과 URDG758과는 달리 UCP600에서는 불가항력으로 인한 은행 영업중단에 대하여는 유효기일 연장을 인정하지 않고 있기 때문이다. 불가항력으로 인한 이러한 불이익으로부터 수익자를 보호하기 위하여 첫째, 신용장에서 지정은행을 특정은행으로 제한하지 않고 모든 은행으로 하고, 둘째, 불가항력이 발생한 경우 유효기일의 자동연장을 인정하는 조건을 신용장에 기재하고 셋째, UCP600의 불가항력 조항의 개정을 고려하여야 한다. UCP600의 불가항력 조항을 ISP98과 같이 유효기일을 은행영업 재개 후 30일까지 연장하는 것은 개설은행에 지나친 부담을 주므로 URDG758과 마찬가지로 원래의 유효기일을 30일 연장하는 것이 바람직하다고 생각한다.
Abstract
Under L/C which is subject to UCP600, the beneficiary may not receive proceeds due to his failure to make a complying presentation within validity because banks stop business due to force majeure. This is because unlike URDG758 or ISP98, UCP600 does not permit the extension of expiry date when banks stop business because of force majeure. To protect the beneficiary from those disadvantages caused by force majeure ; 1)it is advisable to nominate any bank rather than a specific bank as a nominated bank, 2)the inclusion of automatic extension of L/C validity in L/C conditions in the occurrence of force majeure is highly recommended and 3)the revision of the provision of force majeure in the UCP600 should be considered to be like that of URDG758, since under URDG758, the validity is extended 30days, which appears to be a rational and proper provision compared to that of ISP98 under which the validity is extended up to 30 days after the resumption of bank business, which may prove to be too burdensome for issuing banks.
