의류 디자인의미국 저작권법상 보호에 관한 연구
A Study on the Protection of Clothing Design under US Copyright Law

의류와 같은 실용품의 디자인에 대한 저작권 보호를 위하여 오랫동안 미국 법원들은 다양한 저작물성 판단기준을 제시해 왔다. 특히 특정 목적을 가지는 코스튬(costume)이나 무도회 또는 작업 유니폼 같은 의류의 경우에는 의복의 전형적인 기능을 가진 의류와 다르기 때문에 여러 순회항소법원들의 각기 다른 분리가능성 테스트를 통한 판결을 거치면서 명확한 결론을 내리지 못해왔다. 그러던 중 2017년에 미국연방 대법원이 치어리더 유니폼 판결을 통하여 실용품의 디자인의 분리가능성 판단기준을 ‘분리된 인식(separate identification)’요건과 ‘독립적 존재(independent-existence)’ 요건으로 나누어 구체적으로 제시하였다. 연방 대법원의 판결이 있은 후, Silvertop Associates, Inc. V. Kangaroo Manufacturing, Inc. 사건에서 바나나 코스튬 디자인의 분리가능성과 저작권의 보호여부가 논쟁이 되었다. 뉴저지 연방지방법원은 Star Athletica 판결을 인용하며 바나나 코스튬의 디자인 요소들을 코스튬의 실용적인 면에서 분리되어 인식이 가능하고 독립적으로 존재할 수 있는 회화, 그래픽, 조각저작물로서 저작권 보호대상이라고 판단하여 피고에게 예비적 금지명령을 내렸다. 연방 대법원의 치어리더 유니폼에 대한 판결을 감안한다면 바나나 코스튬 디자인의 저작물성이 부정될 가능성은 적어 보인다. 무엇보다도 연방 대법원의 판결이 있은 후 제기된사건이어 바나나 코스튬 사건의 항소심 판결 결과에 귀추가 주목된다. 본 논문에서는미국에서의 의류 디자인에 대한 저작권법상 보호 연혁과 코스튬 디자인의 저작권보호와 관련한 선행 판례들을 살펴보고 최근 제기된 바나나 코스튬 사건을 면밀히 검토하고자 한다. 마지막에는 우리 저작권법상 응용미술저작물 규정의 해석에 비추어 미국의 바나나 코스튬 디자인이 응용미술저작물로서 보호를 받을 가능성이 있는지도함께 검토하고자 한다.
Abstract
After ruling of the US Supreme Court’s in Star Athletica, L.L.C. v. Varsity Brands, Inc. on March 22, 2017, the separability and copyrightability of the banana costume design was disputed in the case of Silvertop Associates, Inc. V. Kangaroo Manufacturing, Inc. The New Jersey federal district court cited Star Athletica’s separability test and held that the banana costume’s design can both be identified separately from and can exist independently from the utilitarian aspect of the costume itself. The court can easily identify the features of the banana costume having a pictorial, graphic, or sculptural quality. The court thus finds, although it uses elements that might in and of themselves not be protectable standing alone, that the design when considered as a whole is separable and eligible for copyright protection. Although the decision of appellate court of the banana costume has not yet been decided, if consider the US Supreme Court’s ruling on cheerleader uniforms, it seems likely that the copyright of the banana costume will be protected. In this article, we examine the history of US clothing design, the precedent cases for copyright protection of costume design, and the recent banana costume case. In particular, I would like to examine whether banana costumes can be protected as applied art works in Korean copyright law.
