Abstract

There has been significant criticism both domestically and internationally regarding the consent system in the field of personal information protection. This paper focuses on the fundamental right of individuals' autonomy and dignity in living in a modern information society, specifically emphasizing the right to self-determination as an intrinsic right in the context of personal information and highlighting consent as a means of exercising this right. In a society shaped by Floridian re-ontology and algorithmic governance, the autonomy of individuals is particularly vulnerable. Legislation that neglects or encourages the deceptive expression of the autonomy of data subjects cannot fulfill its responsibilities. Therefore, it is essential to rectify approaches that excessively rely on the consent of data subjects without serious consideration of the legal basis for the lawful processing of personal information. Based on awareness of the issues mentioned above, this paper proposes two main directions for improvement. Firstly, reduce the scope of consent as a legal basis for personal information processing while enhancing its effectiveness and significance. This involves imposing disadvantages or sanctions for the misuse of consent. Secondly, once the areas where consent can be effective are precisely identified, improve the consent-taking process by notifying the information subject only in the areas of genuine interest to them. The first proposed improvement draws inspiration from the perspectives of GDPR in Europe and PDPA in Singapore regarding the consent system. These approaches share a commonality in ultimately reducing the reliance on consent as a legal basis for personal information processing. However, there is a distinct difference in views regarding the autonomy of data subjects between the Singaporean approach, which seems to emphasize the objective legitimacy of personal information processing rather than striving to enhance the completeness of individual consent, and the European approach, which places limits on obtaining consent even in areas that may not significantly contribute to meaningful functionality. This paper introduces the concept of misuse in the consent system, inspired by the latter approach that respects autonomy, and proposes the contextual integrity theory as a clue to concretize this concept. This approach appears to be effective in addressing issues stemming from the requirement of 'separate consent' for sensitive information processing under current law. The second improvement considers limitations identified through empirical research on the capacity of data subjects. While various limitations are pointed out regarding the data subjects’ capacity to consent, efforts are necessary to enhance the effectiveness of the consent system since the system is maintained in specific domains.
