Abstract
As crimes such as sexual violence against children continue to occur, various sanctions have been introduced to protect society from the risk of sexual violence criminals reoffending, such as electronic anklets, registration and disclosure of personal information, electronic supervision system, employment restrictions, and sexual impulse drug treatment. Recently, considering that a significant number of sexual crimes occur near the residences of sexual assault offenders, the introduction of a residence restriction system to restrict the residence of sexual assault criminals is being discussed. This system has its origins in Florida's Jessica Law, which prohibits sex offenders from living within a certain distance of child-friendly facilities. Currently, about 40 states in the United States operate a system to restrict the residence of sex offenders, and the unconstitutionality of this has been consistently raised recently. In addition to discussing whether the legal nature of residence restrictions for sex offenders in the United States constitutes criminal punishment, we also analyzed the situations and overall effects that sex offenders face through residence restrictions, and how much they contribute to preventing recidivism, which is the original purpose of this system. There were various discussions going on, including empirical and empirical evidence. In this paper, we review the rulings on the unconstitutionality of the residence restrictions for sex offenders in the United States and, based on these, seek to obtain implications for the legislation and policy of the Korean version of Jessica's Act, which designates the residence of sexual offenders.
