Abstract

According to Max Weber’s famous thesis, modern world is characterized by a process of disenchantment. Instrumental rationality supposedly takes the place of religious and traditional authorities. The phenomenon can be found in the field of law to the extent that very few people today believe the law should be obeyed because it is God’s command. Yet, it may be that disenchantment has yet to take place in constitutional theory. When we look at the terms and frame of reference commonly used by constitutional theorists to discuss and explain the legitimacy of a constitutional order, we find that they are derived from theological contexts. This is particularly true in the case of the idea of popular sovereignty. This article seeks to show that the emergence of popular sovereignty is the result of two inter-related processes in the intellectual history of the West, both of which are deeply imbued with religious overtones. First, it shows that the way in which we use and understand the idea of sovereignty is directly related to the medieval debate between Thomists and Nominalists on how to understand the sovereignty of God. Secondly, it describes how the idea of people, originally a term for the poor and uneducated masses, underwent a process of sacralization to become an eternal and everlasting divine being standing outside the secular world. It was the confluence these two trends that produced the modern theory of popular sovereignty. In other words, a will-oriented conception of divine sovereignty was inherited by the modern world and imputed to an entity called the ‘people’ which resembled less and less the actual historical individuals who work together to establish and operate a democratic constitutional order. To the extent that constitutional theory of popular theory remains ‘enchanted,’ the actual people in the real world will continue to be neglected and disempowered.
