밀의 자유론은 대학생들의 필독서로 꼽힌다. 이 논문은 자그마한 가이드역할을 하려고 하며, 이 책의 중심 주제이자 연구자들 간에 견해가 대립되는 자유제한의 원칙의 내용이 무엇인가의 문제에 대해 결론을 제시하고자 한다. 먼저 이 논문은 번역의 문제를 다루는 것으로부터 시작한다. 그리고 이어지는 장부터는 밀이 어떠한 원칙에 따라 개인의 자유를 제한할 수 있다고 보았는가에대해 논한다. 필자는 이에 대한 판단에는 19세기 서구라는 시대와 사회에 대한밀의 평가와 미래에 대한 전망이 중요하게 작용하고 있다는 점을 충분히 고려해야 한다고 본다. 이러한 관점에서 볼 때 밀은 개인의 자유에 대한 제한의 원칙을 폭넓게 인정하고자 하지 않은 것으로 판단된다. 필자는 밀이 자유제한의 원칙으로 해악의원칙, 공리주의 일반 원칙, 불쾌감의 원칙, 후견주의 원칙을 수용한다고 보았다. 그렇지만 밀이 이들 원칙들에 동등한 비중을 둔 것은 아니라고 생각한다. 그 근거는 서술의 순서에서 찾을 수 있다. 제1장에서 해악의 원칙과 공리주의일반원칙을 제시한 반면에, 불쾌감의 원칙과 후견주의 원칙에 대해서는 제5장에서 논의하였다. 따라서 밀은 전자의 원칙들을 일반적인 원칙으로, 후자의 원칙들을 보충적인 원칙으로 제시한 것이다. 다시 말해 전자의 원칙들과 후자의원칙들 간에 중요성의 서열을 인정한 것이다. 밀이 자유론에서 문제점으로 지적하고 그에 대해 처방을 제시한 것은 현재에도 적용된다고 생각한다. 밀의 평가는 사회의 통제가 더욱더 강해져서 우리의 “영혼까지 통제”하는 것이 현실이고 이는 소멸되지 않을 것 같다는 것이다. 이런 의미에서 자유론은 21세기에도 반추되어야 할 저작일 것이다.
Abstract
This paper aims at providing guidances for readers of Mill‘s On Liberty. At the beginning of this paper, I reviewed Korean translation by Professor Byoung-hoon Seo and suggested some corrections. In the following chapters, I examined Mill’s theory of when the liberty can and should be restricted. I emphasized that Mill should be viewed as one of thinkers who estimated the restriction of individual liberty and autonomy negatively with regard to the historical tendency of the 19th century, and readers should keep such a perspective in mind. I concluded that Mill did not recognize the liberty-limiting principles broadly but accept to restrict individual liberty according to such principles as harm principle, general principle of utility, offense principle, paternalistic principle. In addition, Mill did not see that those principles should have equal weight. Following such an idea, he discussed the former two principles in Chapter 1, and the latter two principles in Chapter 5. The order of discussion reflects his estimation of weight of principles. He regarded the latter principles as supplementary and applicable to only limited cases. As a final comment, I suggest that Mill’s diagnosis and prescription with regard to the limit of individual liberty should be regarded seriously. He said that the 19th century social control already arrived at the penetration into the details of life and enslaving the soul itself, and had been getting worse in that the power of society over the individual grows more and formidable.
