우리나라에서 國際標準銀行慣行(ISBP)의 適用上의 問題點에 관한 硏究

국제표준은행관행(ISBP)이 간행된 지 3년이 경과하고 있는데, ISBP는 예상외로 큰 성공을 거두고 있다. 미국, 유럽, 아시아 각국에서 ISBP의 사용으로 신용장에 관한 불일치 및 소송 건수가 크게 감소하고 있다. 그런데 ISBP는 신용장통일규칙(UCP)과 같은 강력한 구속력을 갖지 못하며, 간행 후 9개 항목에 관한 정정이 이루어지는 다소 불완전성을 갖추고 있다. 또한 ISBP는 우리나라 실무관행과 비교하여 총칙상 및 서류제시상 문제점이 있다. 먼저 총칙상 철자 상위 또는 타이핑 에러를 지나치게 관대하게 처리하고 있는 점, 만기일의 기산일이 상이한 점, 수익자 발행 서류의 언어 제한 문제, ‘from’의 해석이 상이한 문제를 가지고 있다. 다음으로 제시서류상 은행들에게 과도한 지식의 보유와 책임 강화라는 점을 지적할 수 있다.그렇지만 ISBP로 인해 신용장과 관련된 분쟁 건수가 감소하고, 신용장의 이용이 활성화될 수 있다면 신용장 관계 당사자 모두에게 큰 이익이 될 것이다. 은행들도 책임증가에 비례하여 수익이 증대할 것임은 쉽게 짐작이 가능하다.
Abstract
Three years have passed since the publication of International Standard Banking Practice for the Examination of Documents under Documentary Credits(ISBP) in January 2003. ISBP has achieved great success and it has led the decrease of the numbers of discrepancies and lawsuits regarding letters of credit. However, ISBP does not have strong governing power like UCP and has somewhat incompletion. Also, ISBP has some problems concerning general provisions and presentation of documents. First, it has the problems of misspelling, starting point of maturity date, language, and interpretation of term ‘from’ in general provisions. Next, it has the problem of levying excessive knowledge on banks in presentation of documents. Nevertheless, it will benefit all of the parties concerned with letters of credit if it leads the decrease of lawsuits and the increase of using of letters of credit. Banks will yield more profits in proportion to the increase of duties.
