The Application and Reality of Documentary Compliance Standard in a Letter of Credit Transactions

초록

본 연구는 2007년 7월 1일자로 시행되고 있는 UCP 600상 서류심사를 위한 일치성 기준에 대한 변화내용과 쟁점 및 그 적용에 대해 개정․시행되어 3년이 지난 현 시점에서 분석함으로서 현실적인 적용기준을 확립하는데 기여하며, 특히 적용상 현실적 쟁점에 대한 시사점과 그 유의점을 제시하는데 있다. 이러한 화환신용장 시스템에서 대금결제는 제시서류의 일치성을 전제로 이행된다. 은행에 제시된 서류와 신용장조건과의 일치성 판단은 제시서류의 수리 여부에 관련된 신용장대금의 지급과 분쟁의 해결에 중요한 기준이 된다. 즉, 은행은 제시서류가 신용장의 조건과 일치한 서류에 한하여 지급의무를 이행해야 한다는 원칙을 말한다. 따라서 신용장거래에서 서류의 일치성 기준은 매우 중요한 거래원칙이다. 그러나 이와 같은 제시서류의 일치성을 판단하기 위한 기준은 UCP의 개정으로 많은 변화가 있었으며, 그 변화는 획기적이라고 볼 수 있다. 즉 지금까지와는 달리 그 일치성의 기준이 실질적으로 완화된 실질일치의 원칙을 수용했다고 볼 수 있다. 그러므로 이러한 회기적인 기준의 현실과 그 적용에 대한 연구가 필요하다고 본다. 따라서 본 연구에서는 이와 같이 변화된 UCP 600에서의 서류의 일치성 기준과 그 이전 UCP 500과의 비교, 그리고 신용장거래에서 그 일치성 기준의 실질적 적용과 주요 쟁점을 분석하고 그 유의점을 제시하였다.
