Abstract

An “Unknown Clause” is a clause or remark in a bill of lading which means that a carrier does not know the contents, weight, quality etc. of a cargo. In the U.K., it is generally accepted by the Court that the “Unknown Clause” is valid and a bill of lading which has a “Unknown Clause” can not be prima facie evidence of the receipt by the carrier of the cargo as therein described. Under Korean law, the “Unknown Clause” shall be held valid as in the U.K. for a container cargo or other cargoes, so far as the information on the contents of these cargoes is not available to a carrier. On the other hand, if a bill of lading has an “Unknown Clause,” a carrier should be entitled to limit his liability based on the number of the packages or shipping units that were actually laden on board a vessel rather than that described in the bill of lading.
