영국해상보험법상 최대선의의무의 인정에 관한 대법원 판례평석 - 대법원 2005.3.25.선고, 2004다22711,22728판결 -

우리 대법원은 대법원 2005.3.25.선고, 2004다22711,22728판결에서 피보험자의 사기적 보험금 청구에 대하여 영국보험법 제17조에 규정된 최대선의의무 위반을 이유로 보험자가 보험계약을 취소할 수 있다고 판결하였다. 영국 법원은 영국보험법 제17조에 규정된 최대선의의무와 관련하여 그 법적 근거, 적용범위 및 의무위반의 효과와 관련하여 논쟁을 거듭하고 있고, 그 결과 계약체결 전 선의의무의 실체 규명은 어느 정도 완수단계에 있다고 할 수 있으나, 계약체결후의 선의의무의 법적 근거, 적용범위 및 의무위반의 효과는 여전히 불명확한 상태이다. 본 논문은 최대선의의무와 관련된 최근 영국 판례법의 변화를 소개하고 이를 분석함으로써 우리 대법원의 영국해상보험법상 최대선의의무의 인정에 관하여 몇 가지 문제점에 대하여 고찰하고자 한다.
Abstract
Korean Supreme Court on the Case 2005.3.25., 2004DA22711,22728 judged the insurer may avoid the marine insurance contract against fraudulent claim, in the reason of the violation of the duty of utmost good faith. English case law about the duty of utmost good faith on the Marine Insurance Act(1906) Section 17 is disputable, while the nature and scope of the pre-contractual duty of utmost good faith are fairly clear, the principle of post-formation duty has not been established clearly. In this article, I analyze the scope and duration of the duty of utmost good faith in recent English case law and comment on some issues of Korean supreme court case about analysis of utmost good faith provision on english Marine Insurance Act(1906).
