Abstract

Analogical method, or inference by example is necessary not just for Anglo-American law but also for every judicial decision-making. Dealing with a case by a judge always means the determination of similarity or difference regarding new facts. Abstracting particular facts in each individual case pursuant to the issue of the case is fundamentally constructive, whether intensive or not. For analogy, a legal concept is merely exploited to provide a meaning and an order for a case. That is, analogical method break up and also reconstruct intension and extension of a concept to resolve a particular controversy. Analogy ought to explain this two kinds of functions simultaneously. Inference of two cases as similar means that there already comes a kind of categorization that make such analogy possible. Categorization for analogy can be typological forms that is adjacent to our initial perception and also strict conceptual formality or structure. Categorization for analogy is not a priori fixed congelation but can be a form constructed following particularities of a case and a context. In other words, real substance of a case is not predetermined before actual consideration. There have never occurred a mechanism to control an understanding of a case and a reconstruction of a concept. Therefore, analogical process is non-deterministic. Analogy is not a discovery but a mental process very close to invention. Because the similarity of two different cases that can never be the completely same is pursued to be identified, analogy is inherently a type of metaphor. Analogy has its ground on experiential intuition. No criteria inside or outside of a legal concept can control a change of intention and extension of the concept through analogy. Although many rhetorics about rationale for analogy can be carried out, what determines the weight of that analogical process is rational intuition. In fact, the rule of law generally aims for clarity, consistency, predictability with its’ formality. Nonetheless, the substance of legal norm is not dumped into formality. Formal rules is just a matter floating the vast ocean of legal sensibility and cannot completely explain legal phenomenon. In this sense, the standard of ‘possible meaning of a legal term’that consumes lots of pages of law journals has never been conclusive in spite of the normative request of the rule of law. Modern liberal ideology of the rule of law always hold on to the fate limit from abstraction and generalization. Therefore, the line-drawing for interpretation and analogy is not a given thing but a matter of arguing and deciding. Arguing and deciding is not always rationally explained but is fundamentally based on inexplicable intuition. If you push analogy far enough, you will run away from the world of logical necessity. Thus, to stay with deliberation in applying and interpreting legal term, the uncertainty and the fortuity in legal standards should be taken into serious consideration.
