Abstract

On the one hand, hate speech is understood as an act of violating human rights that is already prohibited in the student human rights ordinance, but on the other hand, it is also understood as an anti-human rights concept that infringes on freedom of expression. Hate speech, its criticism and counter-expressions against it become part of the discourse that forms civic culture, and in many cases mutual reflection is required from both the speaker and the recipient. In that case, hate speech exerts political influence by concentrating the will to achieve the goal(reconciliation of interests, model of order, etc.) that the people speaking hate aim for, while at the same time constructing the identity of the person who expresses it. The same is true for counter-expressions of hate speech. This ‘performative politicity’ develops into an hostile confrontation between the political solidarity of feminism, nationalism, and social democracy, and the solidarity of Christian groups and conservative civic groups. This confrontation finds its intensified shape in the uncompromising antagonism between the position of recognizing the legal regulation of hate speech only to the majority and the position of recognizing the right of conscientious hate speech. Comprehensive legal regulation of hate speech divides the speaker of hate speech into the perpetrator and the recipient into the victim, and appropriates hate speech as an act that creates hurt for the recipient. This deprives both the speaker and the receiver of the opportunity to reconstruct their identity through their own reflection, deprives them of the role of the subject participating in public debate, and demands self-censorship in expressing opinions and emotions from citizens as potential speakers of hate speech. This shrinks civil public opinion as the infrastructure of deliberative democracy, and distorts the democratic process into a mutually convergent homogenization process of courteous and well-behaved arguments, in which hate speech and its counter-expressions have all disappeared. This article maintains a critical distance from the comprehensive legal regulation of hate speech, faces the uncertainty of hate speech that is much worse than the concept of sexual harassment or stalking, and designs the frame conditions (cultural memory, one-sided hatred, actual discrimination effect, agitation) under which hate speech will be exceptionally controlled by the regulatory law including criminal law. Lastly, this article will show the process of examining whether or not the frame conditions are met for each of very many hate speeches is the process of civic discourse and the process of forming a mature civic culture.
