사이버상의 안전과 보호에 대한 독일의 입법동향과 시사점

과학과 기술의 발전으로 인한 경제적 이익, 사이버 산업의 발전 및 사이버 안전과 보호 등의 이익에 비중을 둘 것인가? 아니면 민주주의와 헌법적 가치, 프라이버시 및 정보자기결정권과 각종 기본권의 보호에 비중을 둘 것인가? 선택의 기로에서 우리의 입법･사법･행정에 있어서 참고가 될 수 있도록 비교법적인 분석과 소개를 하기로 한다. 사물인터넷과 빅데이터 기술의 발전으로 인하여 온라인과 오프라인이 연결되고 상호 접속되고 있다. 사이버 안보에 대하여도 사이버상의 안보라는 유형과 오프라인과 결합되는 유형을 모두 포함하여 이론적 접근을 하여 변화하는 현실에 대한 규범력을 유지하여야 한다. 이들에 대한 해답을 얻는 접근방식은 '비교법적인 검토'가 필요하다. 따라서 독일을 중심으로 유럽의 입법들을 검토하여 보았다. 이제 독일은 '헌법, 일반법, 개별법'의 순서로 배열된 매우 체계적이고 구체적이며 기술적으로 업데이트된 입법체계를 구축하고 있다. 헌법적 차원의 독일기본법이 최상위에서 작동하면서 사이버 안전과 보호를 통할하는 규범의 역할을 한다, 그러면서 일반법으로서 「전자정부법」, 「행정절차법」, 「IT 안보법」, 「IT망법」, 「IT-국가계약」,「무선통신국가계약」등을 구축하고 있다. 개별법으로서 헌법과 일반법을 구체화하고 있는 것으로서, 「전기통신법」, 「텔레미디어법」, 「정보보호법」, 「국제적 테러와의 전쟁에 있어서의 정보교환을 개선하기 위한 법률」, 「에너지 산업법 」, 「접근차단법」등이 있다. 이들 법률들의 구체적인 내용을 검토하고 이에 대한 평가를 함으로써 우리 입법에 도움이 될 수 있도록 분석하여 보았다. 독일의 판례들도 인구조사 판결과 온라인수색 판결, 유튜브 판결 등의 주요 판결 등을 유럽연합사법재판소의 슈렘스 판결과 함께 검토하였다. 결국, 우리에게 주어진 과제는 법치주의의 근본을 잘 지키면서 사이버 안전과 ‘조화’될 수 있도록 하는 방향으로 입법과 행정 및 사법을 설정하여야 한다. 따라서 주체, 절차, 형식, 내용상의 적법 요건에 부합하는 법과 행정 및 판례를 형성해 나가는 데 많은 노력과 비용을 투입하여야 하는 것이 앞으로의 중심과제이다.
Abstract
We shall choose the way which is convenient for merits that are from science and technology or on the contrary the way for democracy and human rights? I've tried to access to this theme with comparative law analysis especially using german law. I've analyzed many german laws on the cyber security classifying three step systems. There are from 'German Constitution' to 'general law' for example electronic government law, administrative procedure law, IT security law, IT Net Law etc. In addition to these laws there are also 'individual law' for example, Telecommunication Law, Telemedia Law, Data Protection Law, Energiewirtschaftsgesetz Law to improve information exchange in the fight against international terrorism and protect IT-fundamental Rights etc. Also I have researched and analyzed german court's decision including Census decision, Online investigation decision, Youtube decision and CJEU's Schrems decision etc. Now with the IoT and Big Data technology, the wall and borders are disappearing very fast between off-line and one-line society. Therefore we are in need of change the way of thinking from separation of these two society to integration and convergence. Finally in this Information Society, legislation, administration, Judicial shall be changed for adaptation at developing and growing risks and dangers in cyber security. Especially we shall not abandon the value and interest of Human Rights including IT-fundamental as a price of convenience from science. We shall pursue the harmonization between both of them.
