최근 독일에서의 사이버범죄의 발생 현황 및 대처 노력

정보통신기술의 지속적 발달로 인해 신기술을 활용한 사이버범죄 역시 지속적으로 진화하고 있어 이에 대한 지속적인 관심과 규제 노력이 요구되며, 시공간을 초월한 사이버범죄의 특성상 국가간의 지역적 경계가 무의미하고, 발생범죄의 유형이나 특성이 유사하여 국내 관련 법제의 정비를 위해 외국의 입법례를 참고할 필요성이 크다. 특히 사이버테러 등과 같이 국제적 협력이 중요한 분야의 경우에는 법제 상호간의 관심과 합일의 노력이 계속 요구된다는 인식하에 본 논문은 앞으로 우리나라의 사이버범죄 관련 법령의 제․개정 논의에 참고가 될 수 있도록 최근 독일에서의 사이버범죄의 발생 현황 및 그에 대한 대처 노력, 구체적으로 사이버범죄에 대응하기 위한 독일의 그간의 법령 개정을 이끌었던 EU법규범(사이버범죄협약(2001), 아동포르노기본결의(2003), 리스본조약(2009), 정보시스템에 대한 공격에 관한 지침(2013))의 주요 내용 및 관련 독일 개정법(41차 형법개정(2007), 전기통신감청 등 관련 형사소송법개정(2007), 아동성착취 및 아동포르노척결법(2008), IT보안법(2015))을 차례로 소개한 후에 이들 법령 개정의 시사점을 논의하였다.
Abstract
With the fast advancement of information and communication technology, cybercrime has developed and is continuously evolving. As most cybercrimes are transnational in nature and become more widespread and damaging, international coordination and cooperation are necessary in fighting cybercrime on the one hand, but on the other, respecting each nation's sovereignty and constitutional and human rights cannot be understated. To provide an understanding of the European Community(EC)'s efforts in the harmonization of cyberlaw in EC member states for efficient detection and prevention of cybercrime as well as individual member states endeavors to preserve their specific legal culture, this article researches the recent revised German cybercrime laws and related (EC) regulations, such as Convention on Cybercrime (2001), Decision on Combating Child Pornography (2003) and Treaty of Lisbon (2009) which are significant and influential in relation to German cybercrime laws.
