부동산거래제도는 거래규제제도와 거래안전을 위한 제도로 크게 구분된다. 부동산거래규제제도는 토지거래허가제, 농지취득자격증명제, 투기과열지구내 전매제한제, 부동산실명제, 부동산소유권이전 등기신청의무제, 부동산실거래가격 신고제, 지정지역내 양도소득세 실거래가격기준 과세제, 주택거래신고제 등이 있다. 부동산 거래안전을 위한 제도로는 토지거래허가제와 관련된 토지선매제, 토지비축제, 중개업자의 손해배상책임제, 에스크로우와 권원보험 등이 있다. 저성장시대에 들어서면서 종전에 투기와 탈세를 방지하는 기능을 담당하였던 부동산거래규제제도는 대폭 완화되고 있으며, 규제대상이 되었던 지역들은 해제되고 있다. 한편으로 부동산거래의 안전을 위한 제도들은 아직도 제대로 기능하지 못하고 있다. 이러한 시대상황에 적극적으로 대응하고 중장기적으로 부동산 문제를 해결하기 위해서는 거래규제보다는 거래안전에 중점을 두어 관련 제도들을 재정비할 필요가 있다. 부동산 거래안전을 위한 제도는 여러 기준에 따라 나눌 수 있겠지만 주체별로 공적부문에서의 토지선매제, 토지비축제, 중개업자의 손해배상책임제와 사적부문에서의 에스크로우(escrow)와 권원보험제도로 구분할 수 있다. 이러한 제도들은 지금까지 제대로 운용되지 못하였다. 제도의 실효성을 높이기 위해서는 중장기적으로는 토지선매제와 토지비축제는 통합하고, 중개업자의 손해배상책임제와 에스크로우 그리고 권원보험제도는 연계될 수 있는 방향으로 정비되어야 할 것이다. 나아가 부동산 거래규제제도와 거래안전제도를 함께 아우를 수 있는 부동산거래기본법(안)의 제정이 필요하다.
Abstract
The system of Real Estate transaction divided between transaction regulation and prevention against the accidents of it's. The former be contained Land Transaction Permission, Qualification Certificate for Acquisition of Farmland, Restriction of reselling Housing in Overheated Speculation District, the Registration of Real Estate under actual Titleholder's Name, Duty to Apply for Registration of Transfer of Property, Report on Transaction of Real Estate, Transfer Income Tax in Designated Area, Report on Housing Transaction, etc.. Also, the latter be contained Land Pre-emption related to Land Transaction Permission, Land Banking, Real Estate Broker's liability for damages, Escrow, Title Insurance, etc.. Nowadays our land and hosing market is stablizing along with low growth in economy. This study centers around to review the system of Real Estate transaction in accordance with the changing times and circumstances. This study has four parts including the introduction and conclusion. The second part describes contents of Land Pre-emption related to Land Transaction Permission, Land Banking, Real Estate Broker's liability for damages under the individual laws in public sector of Real Estate transaction, and then point out problems of its. The third part describes contents of Escrow and Title Insurance under the individual laws in private sector of Real Estate transaction, and then point out problems of its. The fourth part proposes for efficiency of the land transaction regulation system and improvement of its as follows. 1) There is a need to modify the related laws and revise the provisions of Land Pre-emption and Land Banking in Korea. 2) There is a need to integrate Escrow and Title Insurance into Real Estate Broker's liability for damages. It is the function of these to shift or transfer to a responsible insure risks such as those mentioned in the preceding section. 3) There is a need to refine the system of regulation and prevention against accident of the Real Estate Transaction as a long-term alternative.
