Abstract
The European Commission (hereinafter ‘EC’) believes that while Google has dominated a general internet search market in the European Union (hereinafter “EU”), it has abused its position in a separate comparison shopping market, hurting consumers' interests and foreclosing competition. The EC has been also investigating Android and AdSend for alleged violations of EU antitrust rules. The EU does not concern with the formation of market dominant position, but controls only when an undertaking abuses its position. The EU tends to recognize market dominance when an undertaking has a market share exceeding 40%. Google has more than 90% market share in the general search engine market across the EU and there are high barriers for a new undertaking to enter into the market. That is why the EC decided that Google had a market dominant position in the general internet search market. Under EU antitrust rules, specific forms of abuses are as follows; Exclusive Dealing, Tying and Bundling, Predation, Refusal to Supply and Margin Squeeze. Google has a strategy to combine its additional services with a general search engine. However, as Google entered into a new market, it did not compete with the advantage of its product, but leveraged its market dominance in the search engine market to promote its new product such as Google Maps in a separate market. Google argues that the EC’s market definition is wrong, and that its tying is not in violation of antitrust rules because its practice has countervailing efficiencies. Google is preparing a lawsuit against the EC. In Korea, Google had been investigated allegedly for an unfair trade of Android in an operating system market for mobile phones in the past, but Korea Fair Trade Commission (hereinafter ‘FTC’) decided that it was clear from suspicion. Because Google had just a small market share and there were no foreclosing competition in Korea. However, FTC might have a different conclusion from the past if it investigates Google again because things have changed in recent years with a rapid growth of Google. Unlike the EU which regulates Google on the basis of abuse of market dominance, tying, Korea might control Google with a different tool such as Unfair Trade because its Monopoly Regulation and Fair Trade Act has a different structure from the EU antitrust rules.
