Abstract
Competition policy is facing new challenges in a blossoming digital economy where platforms compete across industries, and dominant incumbents might foreclose innovative startups from an array of markets, which calls for timely regulatory intervention. The recent EU investigation into Google search engine shows us a couple of important points in this regard. First, the tools for market definition and market power assessment that the EC has applied turned out to be a little outdated to reflect fully the special characteristics of digital platform markets: dynamic, multi-sided markets with zero-price products. Those tools need to be adapted to the new economic environment. Second, quite differently from the US antitrust laws, the EU competition law recognizes the special responsibility of dominant undertakings and focus more on the guarantee of market access by other undertakings. Thus the latter could have some advantages in regulating the abuse of dominance in digital platform markets. In order for Korean competition law to prevent market foreclosure by dominant platforms and to promote competitive environment for innovative startups, (i) we need to develop new tools for market analysis which could better reflect the special characteristics of platform markets, and (ii) we also need to consider introducing European principles on the abuse of dominance, focusing more on the guarantee of market access by undertakings, into Korean competition law.
