「UN 아동권리협약」제4조의 이행상황

우리나라는 1990. 11. 20. UN 아동권리협약을 비준하고, 정기적으로 UN 아동권리위원회에 그 이행상황에 관한 보고서를 제출하고 있다. 본 논문에서는 2017년 제5ㆍ6차 통합 국가보고서 제출에 앞서 협약 제4조의 이행상황을 점검해 보고자 한다. 협약 제4조는 협약상 아동의 권리를 실현하기 위해 가입국이 자국 내에서 시행해야 하는 조치에 관한 일반조항으로서 해당 국가의 아동권리에 대한 인식 수준과 실천의 정도를 가장 극명하게 보여주기 때문이다. 하지만 안타깝게도 분석 결과 현재까지 협약 제4조의 이행 수준은 그다지 높지 않은 것으로 밝혀졌다. 협약 제4조의 이행을 위해서는 협약 유보조항에 대한 철회, 협약상 권리침해시 아동의 구제수단 완비, 통합 아동권리법의 제정, 협약의 국내법적 효력 보장과 모니터링 제도 도입, 관련 국제조약에의 가입, 아동정책조정위원회의 활성화 및 아동을 위한 포괄적 국가전략의 개발, 아동영향분석과 아동예산분석 제도 도입, 아동의 권리실현을 위한 예산확보와 국제적 협력 의무 등 다양한 조치가 행해져야 한다. 우리나라는 2011년 UN 아동권리위원회의 최종심의결과에 따라 입양허가제의 도입, 아동의 소송능력과 법정대리인 관련 규정 정비, 아동정책조정위원회의 재개 및 아동정책기본계획 수립, 국가인권위원회에 의한 모니터링 업무 수행 등 몇몇 발전을 이루었으나, 여전히 비상계엄 하에서 아동의 상소권을 박탈하고 있고, 아동영향분석과 아동예산분석 제도를 도입하지 않고 있으며, OP3-CRC를 비롯한 주요 아동 인권 관련 국제협약에 대한 비준을 여전히 미루고 있을 뿐만 아니라, 가용자원에 비해 아동 관련 예산 지출이 턱없이 부족한 상황이다. 본 논문을 계기로 2017년까지 협약 제4조의 이행 상황이 개선되기를 기대한다.
Abstract
Republic of Korea has ratified United Nations Convention on the Rights of Children(UN CRC) in 1990 and submits regularly a performance report to the UN Committee on the Rights of the Child. This article is written for inspecting the performance status of UN CRC article 4 in preparation for a performance report in 2017. The Article 4 is very much in the foreground of UN CRC, because it is a barometer of the cognition and praxis on children in a country as a provision for general implementation of the children's rights. Therefore I have studied the specific meaning of the article 4 of UN CRC at first, and then examined the current performance status of the article in light of the meaning, which turns out to be unsatisfactory, so that suggested some measures to be taken for improving performance level of UN CRC in conclusion, for example the withdrawal of reservation, the ratification of OP3-CRC and other international treaties, the enactment of Children's Rights Act, the introduction of child impact system and the expansion of budget for child.
