러시아 사법제도개혁 연구 - 배심제도입논의를 중심으로 -

한국사회에서 배심제 도입에 대한 논의가 진행되는 것을 보면서 미리 시행한 다른 나라들에 비해 좀 늦은 감은 있지만 한편으로는 매우 환영할만한 제안으로 보여 진다. 배심제도를 도입함으로서 국민들의 사법참여를 통한 시민사회로의 발전을 기대할 수 있으며, 형사소송절차를 보다 인권이 존중되는 방향으로 바꿀 수 있을 것이다. 본 논문에서는 한국사회에도 배심제를 도입하기 위한 모델로서 러시아의 배심제 도입에 대한 역사적 배경과 과정, 배심재판의 현황에 대하여 고찰하려고 한다. 물론 배심제의 도입과 관련하여 배심제의 모태인 영국, 또는 배심제가 가장 활발하게 운영되고 있는 미국의 모델이 중요한 것은 사실이지만 러시아의 배심제 도입은 가장 최근에 1864년에 사법개혁의 일환으로 도입된 배심재판을 부활하여 시행하고 있다는 측면에서 이제 막 도입을 준비하는 우리에게 많은 경험적 함의와 유용한 자료를 제시해줄 수 있을 것으로 기대된다. 러시아에서 배심재판의 부활은 시장경제로 체제전환을 시도한 1990년대 초반부터 논의되었으며, 2003년에 형사소송법을 전면 개정함으로써 전국적으로 시행되고 있다. 물론 러시아의 경우에 이미 19세기 중반에 배심재판을 운영하던 경험이 있으며, 한편으로는 소비에트의 형사절차가 참심제에 기초해 있었다는데서 우리와 다른 측면이 있기도 하지만, 새롭게 다시 부활한 러시아의 배심제를 연구하면서 우리의 배심제 도입에 있어 적용상의 문제점이나 절차상의 오류를 극복하는데 도움이 될 것이다. 뿐만 아니라 러시아는 제정러시아와 소비에트를 거치면서 배심제와 참심제를 모두 경험하였고, 현재에도 경제관련 분쟁 및 외국인투자 문제를 심의하는 사법기관인 중재재판소에서 참심제가 그대로 유지되고 있다는 것을 고려해보면 두 제도의 장단점을 비교 고찰할 수 있는 유의미한 기회가 되기도 한다.
