일본항공의 도산 사건은 일본 회사갱생절차의 대표적인 성공사례로 손꼽히고 있다. 해당 사건은 기업재생지원기구라는 단체의 주도로 진행되었는데, 위 기구의 개요 등을 통하여 국가의 기간산업을 담당하는 기업의 재건을 위하여 정부의 자금이 어떠한 형태로 지원될 수 있는지 확인해 볼 수 있다. 또한, 일본항공 도산 사건의 개요를 확인해 봄으로써 해당 사건에서 사적 정리절차와 법적 도산절차가 병용된 이유는 무엇인지, 정부의 지원 하에 도산 절차에 의한 대기업의 재건이 진행되는 경우, 정부와 각 기관, 그리고 법원이 어떠한 형태의 협의와 준비과정을 거치게 되는지 등을 살펴볼 수 있다. 일본항공 도산사건은 일본 내에서 다양한 법적 이슈를 양산하였고, 이러한 이슈들은 유사한 도산법제를 가지고 있는 한국에서도 연구의 필요성이 있다. 뿐만 아니라 조만간 조선, 철강 등의 분야에서 정부 주도의 대규모 구조조정 절차를 앞두고 있는 한국에게 여러가지 시사점을 던져 주고 있다고 생각한다.
Abstract
The bankruptcy case of Japan Airline is one of the successful Reorganization proceeding cases in Japan. The proceeding was led by an organization named the Enterprise Turnaround Initiative Corporation of Japan. This case shows that how the governmental funding can be provided to the restructuring of a company which involves the country’s major industry. Furthermore, by analyzing the bankruptcy case of Japan Airlines, we may able to find the reason why both of the Private Corporate Reorganization proceeding and the Bankruptcy proceeding were taken together in this case. We may also able to find how the government, the institutions involved and the court cooperate and prepare in a case where there is a reorganization proceeding of major company going under the governmental support.
