초록

사회주의재산(국가재산과 협동조합/협동농장재산) 침해범죄를 개인재산 침해범죄와 구분하고 전자를 더 엄중하게 처벌하는 것은 현재 북한 형법과 과거 사회주의 형법의 주요 특징이다. 본 논문은 동유럽과 동아시아 지역의 과거 또는 현재 사회주의국가를 망라하여 형법상 사회주의재산 침해범죄 규정의 기원과 발전, 쇠퇴를 조망한 첫 연구이다. 사회주의재산 침해범죄 규정은 스탈린 집권기 소련에서 처음 만들어졌으며, 사회주의재산 절도의 기본형이 사형으로 명시되는 등 스탈린 시대 공포정치를 강화하고 독재체제 구축을 뒷받침하는 역할을 수행하였다. 이후 이 규정은 소련이 군사적, 정치적으로 막대한 영향력을 행사한 동유럽 지역 사회주의국가들의 형법전과 아울러 북한 등 동아시아 지역 여러 사회주의국가의 형법전에도 직접적인 영향을 끼쳤다. 그러나 소련의 사회주의재산 침해범죄 규정은 스탈린 사망 후 형법전을 개정하는 과정에서 개인재산 침해범죄 규정과 비교할 때 처벌의 수준 등에서 차이가 현격하게 줄어들었다. 이러한 변화는 동유럽 지역의 다른 사회주의국가에도 영향을 미쳤다. 특히 사회주의권이 해체되기 시작한지 얼마 지나지 않은 1990년대 초부터 동유럽 지역 체제전환국가들의 형법전에서 사회주의재산 침해범죄 규정이 삭제되면서 재산범죄편에 통합되었다. 이러한 변화는 시장개방을 통해 자본주의적 요소를 수용하기 시작한 동아시아 등 다른 지역의 사회주의국가들 형법전에서도 다소 시기를 달리 하여 공통적으로 나타났으나, 북한만은 아직도 예외로 남아있다. 본 논문에서 과거 또는 현재 사회주의국가들의 법제를 전반적으로 검토한 결과 형법상 사회주의재산 침해범죄 규정의 폐지는 시장경제를 수용하기 위한 전제조건이라고 할 수 있으며, 따라서 북한 형법상 사회주의재산 침해범죄 규정의 수정 내지 폐지 여부는 향후 북한의 시장개방과 경제발전 의지를 판단할 수 있는 한 가지 기준이 될 수 있을 것이다.

Abstract

Distinguishing crimes against infringement of socialist property (state property and property of cooperatives, etc.) from crimes against private property and punishing the former more severely is a major feature of past socialist criminal laws, including the current North Korean Criminal Code. This article is the first to examine the emergence and demise of penal sanctions against the infringement of socialist property in the laws of former or current socialist countries in Eastern Europe and East Asia. The special regulations on crimes against infringement of socialist property were first created in the Soviet Union during Stalin’s reign, and the basic punishment for theft of socialist property was the death penalty. The regulations strengthened the mass repression of the Stalin era and supported the establishment of his dictatorship. Since then, this regulation has had a direct impact on the criminal codes of socialist countries in East Asia, including North Korea, along with socialist countries in Eastern Europe, where the Soviet Union exerted enormous military and political influence. However, in the process of revising the criminal code in the Soviet Union after Stalin’s death, the level of punishment in the provisions on crimes against infringement of socialist property significantly decreased, thereby reducing the difference between those provisions and those on crimes against private property. Since then, these changes began to affect other socialist countries in Eastern Europe. From the early 1990s, soon after the socialist bloc began to disintegrate, in the criminal codes of the transition countries in Eastern Europe, the provisions on crimes against socialist property infringement were integrated into the chapter on property crime. Such changes are also found in the criminal codes of socialist countries in other regions, such as East Asia, which started to accept capitalist elements through market opening over time, but North Korea still remains an exception. After reviewing the evolution of provisions against the infringement of socialist property in the criminal codes of many former or current socialist countries, this article concludes that the abolition of such provisions is a prerequisite for creating a market economy. Therefore, whether North Korea revises or abrogates its sanctions against the infringement of socialist property will be a touchstone of the country’s will to open up its market and achieve economic development.
