Canada와 Rockhopper v. Colombia, Rockhopper v.

Abstract

This paper examines the trends in investor-state arbitration disputes arising from fossil fuel phase-out policy implemented in response to climate change. Over the past decade, numerous countries have adopted policies for transitioning to carbon-zero or low-carbon energy sources. However, these policies have adversely affected investments in the traditional fossil fuel industry, leading to investor-state disputes under investment treaties. In a review of publicly available databases, eight such arbitration cases were identified, with three against Canada and the remainder involving European countries. Of these cases, two have reached final awards on substantive issues: Lone Pine v. Canada and Rockhopper v. Italy. These cases raised issues regarding uncompensated expropriation and violations of the standard of fair and equitable treatment. Additionally, it was observed that the precautionary principle, which has evolved in the field of environmental law, was actively asserted by the respondents. The precautionary principle tends not to be recognized as customary international law yet, but in recent investment arbitration cases, there have been instances where the arbitral tribunal directly applied the precautionary principle in recognizing its adoption under domestic law and in interpreting whether the measure in question violated the treaty – e.g. Eco Oro v. Colombia, Rockhopper v. Italy. Furthermore, in the ongoing case of RWE v. Netherlands, the Netherlands is arguing that the precautionary principle is customary international law, and the expected outcome of this argument is drawing attention. From a procedural perspective, the active participation of non-disputing parties is notable. The participation of those who are not parties to the dispute can be divided into (i) non-disputing treaty parties and (ii) other third parties, and is generally possible with the permission of the arbitral tribunal based on the investment agreement in question or applicable arbitration rules. However, compared to the submission of amicus curiae briefs by third parties, the participation of non-disputing treaty parties is deemed more significant due to their systemic interest in the interpretation of the agreement. The revised ICSID Arbitration Rules of 2022 have strengthened their right to participate by ensuring the right of non-disputing treaty parties to submit their opinions regarding the interpretation of the agreement.
