Abstract

Environmental issue, including climate change, has become one of the most crucial agenda in international society. Even some scientists say the tipping point of climate change has already passed. The urgency of environmental problem cannot be too emphasized. This tendency and reality lead to the increasing number of Investor-State dispute cases related to environmental issues in recent years. In this article, I review several cases where environmental issues were raised in investment arbitrations. In Santa Elena v. Costa Rica case and Pac Rim v. El Salvador case, the Tribunals did not weigh the environmental issues enough. In SDMI v. Canada and Aven v. Costa Rica, each Respondent argued that it adopted the measure to protect environment and it could be justified. Only in Aven v. Costa Rica, the Tribunal accepted the Respondent’s argument. The Tribunal in Aven v. Costa Rica recognized the investor’s rights are subordinate to the State’s authority to regulate on environmental issues, based on the language of treaty saying, “the investment activity … is undertaken in a manner sensitive to environmental concerns.” Also, Costa Rica even filed a counterclaim for environmental damages, which did not succeed. Most of all, Burlington v. Ecuador is quite notable in the perspective of environmental concerns. In Burlington v. Ecuador, the Tribunal rendered a final award in favor of the investor. At the same time, the counterclaim for environmental damages had been also accepted. This was the first case where the Tribunal held the investor liable for the environmental damages of counterclaims. The analysis of these various cases gives us some understanding of the logic and basis for the State to secure its regulatory power regarding environments to win the investment arbitrations. First, the Respondent need to promote and appeal the importance and urgency of environmental concerns to the Tribunals. Also, the party to a treaty or certain entities can file a non-disputing party’s submission to emphasize and convey its view on environmental issues. Besides, some arbitration institutions prepare specific rule applicable to environmental investment arbitration to enhance the professional knowledge of tribunals. Second, the government should negotiate and draft the legal text of investment treaties with great care, to include explicit legal grounds for the state’s environmental obligations and regulatory powers. Third, the party to a dispute should consider the pros and cons of filing a counterclaim against the claimant, i.e., the investor, in case it caused any environmental harm. Often, the counterclaim against the investor might be a strong defense argument to depict the problem of the investment activity and the significance of the environmental concerns in the dispute.
