처음 교회법학회 세미나를 부탁받았을 때의 주제는 “로마 가톨릭교회의 소송절차법”에 관한 것이었다. 근 일 년 동안 그 주제를 생각해 보았지만, 과연 그 주제가 개신교계 교회법전 편찬을 위한 방향 모색에 도움이 될까 하는 생각이 들었다. 오히려 실질적인 도움이 될 수 있는 것은 무엇인지 다시 고민해 보았다. 그때 떠오른 생각이 바로 동방 가톨릭교회의 교회법전이었다. 교회법전 가운데 가장 최근에 편찬된 교회법전이기도 하지만, 무엇보다도 개신교계의 상황, 즉 각 교회마다 고유한 자치를 가지고 있으며, 일정 부분 예배의 형식과 전통이 다르다는 점이 동방 가톨릭교회와 상황이 비슷하기 때문이다. 그래서 논문을 총 2개의 장으로 구성하여, 우선 교회법에 대한 일반적 개념을 고찰하고, 그다음 동방 가톨릭교회에 대해 살펴보았다. 다시 말해서 교회법전 편찬의 전반적인 법제사를 살펴봄으로써, 개신교계가 어떻게 법전을 편찬해 나아가야 할지에 대하여, 부족하지만 생각을 나누고 싶었다.
Abstract
One year ago, I was asked to hold a seminar about the codification of Protestant ecclesiastical law from the perspective of the canonical procedure of the Roman Catholic Church. Since then, I have been wondering if the Roman Catholic perspective would be of real use for the matter, and have found myself become more doubtful, as time went along. Then, I came to think that considering the code of the canons of the Eastern Churches may better serve the purpose for a couple of reasons. In addition to the fact that, of all ecclesiastical codes, the ecclesiastical law of the Eastern Churches has been codified most recently, the Eastern Churches and the Protestant Churches seem to have in common. Namely, each church enjoys its own autonomy and has maintained the distinct patterns of service and tradition. This seminar will consist of two parts. In the first part, I will picture the general concept of what ecclesiastical law may be, and in the second part, I will take a look at the Eastern Churches and its canons. I hope that exploring the history of canon laws in this way will help the Protestant Churches to envision how to codify Protestant ecclesiastical law.
